About this file
This Limited Source Determination document details a brand-specific procurement for the U.S. Army Corps of Engineers (USACE) Walla Walla District at Dworshak Dam. The contract is for Harmsco Water Treatment Filters (P/N PPHC/170-1 and HC/170-.35) to support drinking water systems at the Dworshak Reservoir and Dworshak National Fish Hatchery. The total estimated purchase amount is $56,273.28, which is under the simplified acquisition threshold, and the contract will cover filter requirements for fiscal years 2025 through 2027.
The document justifies the sole-source procurement by explaining that the water treatment systems were specifically engineered for Harmsco brand housings and filters, with operation and maintenance manuals requiring Harmsco-brand replacements. The filters are part of a patented design pre-approved by the Environmental Protection Agency (EPA) and Idaho Department of Environmental Quality (DEQ). Changing components would require costly and time-consuming engineering studies, potentially taking 2-3 years and costing over $100,000. Market research confirmed that only Harmsco brand water treatment filters will meet the government's needs, and previous contracts were awarded through GSA E-Buy.

Limited Source Determination FAR Subpart 13.106-11(b)
1. CONTRACTING AGENCY: U.S. Army Corps of Engineers (USACE), Walla Walla District, 201 N Third Avenue, Walla Walla, WA 99362-1876.
2. DESCRIPTION OF THE ACTION: This action is for a new firm-fixed price, commercial brand name requirement for a procurement of Harmsco Water Treatment Filters, P/N PP- HC/170-1, and Harmsco Water Treatment Filters, P/N HC/170-.35 at Dworshak Dam.
3. DESCRIPTION OF THE SERVICES/SUPPLIES: The US Army Corps of Engineers, Dworshak Dam, Walla Walla District, has a routine, continuous requirement for intermediate and final filters for replacement of warehouse stock. This contract procures the estimated requirement for FY25 through FY27 for the Dworshak Reservoir and Dworshak Fish Hatchery systems.
The estimated amount of purchase is $56,273.28, which is under the SAT.
4. AUTHORITY CITED:
FAR 13.106-1 (b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.
urgency, exclusive licensing agreements, brand name, or industrial mobilization).
FAR 11.105-(a)(1), Items Particular to One Manufacturer. The particular brand name, product, or feature is essential to the Governments’ requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s need.
5. REASON FOR AUTHORITY CITED:
a. BACKGROUND: Dworshak Project operates three separate water treatment systems for drinking water. These critical systems supply drinking water to both federal employees and the public and require constant monitoring and maintenance.
b. JUSTIFICATION: Two of these water treatment systems, Dworshak Reservoir and Dworshak National Fish Hatchery, were engineered and designed for the use of Harmsco brand housings and filters, and operation & maintenance manuals for each system specify Harmsco-brand replacement filters. The Harmsco systems are a patented design and process pre-approved for use in these two drinking water systems by the Environmental Protection Agency (EPA) and Idaho Department of Environmental Quality (DEQ). Any component changes made to this pre-approved design would require costly and time- consuming engineering studies, pilot program testing, and re- approval by DEQ. This effort would take 2- 3 years to scope out, design, precure and install, with a cost of over $100,000.
c. IMPACT: Filters for each of the systems require regular replacement, based on operation & maintenance schedules, as well as operator observations of changing conditions. It is necessary to have these items stocked in the Project warehouse to avoid delays in maintenance actions that may result in interruption to potable water supplies.
d. ALTERNATIVES: Harmsco water treatment filters are the only filters that meet the Government’s need.
6. DETERMINATION OF FAIR AND REASONABLE COSTS: The market for Harmsco water treatment filters is mature and competitive. Therefore, competition should result in a fair and reasonable price; however, no contract will be awarded unless the prices is determined fair and reasonable.
7. EFFORTS TO OBTAIN COMPETITION: Market research indicates that there are numerous other than small business and small business distributors capable of offering the required Harmsco brand name water treatment filters. The previous six contracts were awarded through GSA E-Buy.
8. MARKET RESEARCH: Market research was conducted, and it was determined that only the Harmsco brand name water treatment filters will meet the Government’s need.
9. OTHER SUPPORTING FACTORS: None
10. TECHNICAL CERTIFICATION: I certify that the information supporting this Brand Name Determination is accurate and complete to the best of my knowledge based on the supporting data provided by technical or requirements personnel and my research.
