About this file
This is a Justification and Approval (J&A) document for a brand name, sole source procurement by the Naval Criminal Investigative Service (NCIS). The agency is acquiring 5 Covert Forensic Imaging Devices (CFID) V3 with SkySafe from SCG Canada Inc., distributed exclusively by Teel Technologies, for $TBD (amount redacted) using FY2025 Operations, Maintenance, and Nonappropriated Funds (OM&N). The devices provide unique drone forensic capabilities, enabling digital forensic experts to extract and preview SIM card data and UAV flight logs, addressing a critical investigative need as drone-related incidents have increased, including crashes into naval vessels.
The procurement is being conducted under FAR 13.106-1(b)(1)(i) using 10 U.S.C. 3204(a)(1) authority, justifying the sole source selection because the CFID is the only commercially available specialized device that can extract and immediately view drone data. The agency conducted market research confirming no alternative products meet their requirements, and plans to pursue a small business set-aside competition for future procurements to maximize competition. Delivery is specified as 30 days after contract award, with pricing to be reviewed using FAR price analysis techniques prior to finalizing the contract.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity. Naval Criminal Investigative Service-Headquarters (NCIS-HQ), Business
Operations Directorate, Acquisition Division
2. Description of the Action Being Approved.
Award of a contract on a sole source basis for supplies/services.
Award of a contract on a brand name basis for supplies/services.
3. Description of Supplies/Services.
Supplies or services to be acquired:
The Naval Criminal Investigative Service (NCIS) has a requirement for advanced capabilities to conduct drone-related incident investigations. The Covert Forensic Imaging Device (CFID) with SkySafe provides unique drone forensic capabilities for NCIS. With this new capability, Digital Forensic Experts (DFEs) will be able to extract and preview SIM Cards with watchlists (International mobile subscriber identity (IMSI) and more) and immediately extract and preview flight logs from Unmanned aerial vehicles (UAVs).

Delivery: 30 days after date of contract (ADC).
4. Statutory Authority Permitting Other Than Full and Open Competition. (Select only one.)
10 U.S.C. 3204(a)(1), Only One responsible source and no other supplies or services will satisfy agency requirements.
10 U.S.C. 3204(a)(2), Unusual and compelling urgency.
10 U.S.C. 3204(a)(3), Industrial mobilization; engineering, developmental, or research capability; or expert services.
10 U.S.C. 3204(a)(4), International agreement.
10 U.S.C. 3204(a)(5), Authorized or required by statute.
10 U.S.C. 3204(a)(6), National Security.
10 U.S.C. 3204(a)(7), Public Interest.
5. Rationale Justifying Use of Cited Authority. The acquisition is being conducted under the procedures of FAR 13.106-1(b)(1)(i) – Soliciting from a single source. The justification rationale for restricting competition is the following: The device needed for investigations is manufactured by, and proprietary to SCG Canada Inc., and the only authorized distributor in the US is Teel Inc.
This device is the only product that can meet the Government’s current investigative needs.
6. Specific characteristics of the supplies or services that limit the availability to this/these source(s), i.e., unique features, form-fit-function, etc. State why the requested material or service represents the minimum requirement(s) of the Government. Describe in detail why only this/these suggested source(s) can furnish the requirement(s) to the exclusion of other sources.
The CFID was designed for forward operating military, intelligence, and law enforcement users who need a simple, small and inconspicuous solution for forensic imaging of portable media, SIM cards, iOS and Android devices, UAV flight logs, active and deleted files and much more. The CFID is an operator friendly, hand-held solution that will improve digital intelligence collection while reducing time on target.
The CFID with SkySafe provides unique drone forensic capabilities for NCIS. With this new capability, DFEs will be able to extract and preview SIM Cards with watchlists (IMSI and more) and immediately extract and preview flight logs from UAVs. The frequency and severity of drone investigations is rising. In recent years, drones have crashed into US Naval vessels and fallen onto overseas bases in the middle of public areas. NCIS currently lacks the capability to conduct local, rapid investigation into incidents like these. There is currently no other commercially available specialized device to extract and immediately view data from drones than the CFID with SkySafe.
7. Determination of fair and reasonable pricing.
Pricing will be reviewed prior to award based on price analysis techniques available per FAR 13.106(a).
8. Brief description of Market Research conducted and results, or why market research was not conducted.
Initial Market research was conducted by the requirement owner and NCIS DFEs. No other product in the market was able to provide what NCIS currently needs for these types of investigations and intelligence collection.
Additional market research was conducted to identify sources, both mandatory and preferred, and there is adequate competition from small business resellers. It was determined a small business set-aside competition in the Open Market would be in the best interests of the Government.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
A market review for similar products or services will be conducted on any future procurements to ensure there are opportunities to maximize competition or to reassess the mission needs with the best solution for the Government.
