About this file

This document is a Brand Name Justification and Approval form for a sole-source procurement of a critical safety item. The Military Sealift Command (MSC) requires one Alconza Berango SL Bow Thruster Motor (Part Number MDV-050BBB-J068N) with a required delivery date of December 18, 2025, to be shipped to the MSC BATS Warehouse in San Diego, California. The procurement will be conducted using Simplified Procedures for Certain Commercial Items, with Fiscal Year 2025 Navy Working Capital Funds.

The justification for sole-source procurement stems from the item being a critical safety item for Propulsion/Machinery Control System, with no authorized distributors or direct government sales from the Original Equipment Manufacturer (OEM). Market research included a Sources Sought Notice that received responses from two businesses, and extensive searches of federal contract databases. The contract will be solicited as Other Than Full and Open Competition, with NAVSUP Fleet Logistics Center Puget Sound noting they will continue to accept potential alternative sources for future procurements. The government intends to determine fair and reasonable pricing in accordance with Federal Acquisition Regulation (FAR) procedures.

b. Reason for Authority Cited: The requiring activity has identified the bow thruster motor as a critical safety item: Propulsion/Machinery Control System. Per COMSCINST 4490.1C, MSC N7, the Design Control Activity, has determined that only qualified sources may produce and service these critical safety items. Improperly installed or deficient parts, mission system, equipment, assembly, or support equipment containing a characteristic, the failure, malfunction, or absence of which could cause a catastrophic or critical failure while at sea resulting in loss of or serious damage to the ship, or unacceptable risk of personal injury or loss of life. The parts to be procured must be direct replacement parts for the existing equipment, which must be compatible in terms of form, fit, and function with existing equipment or configurations. Alconza Berango S.L is the Original Equipment Manufacturer (OEM) and maintains proprietary drawings. OEM replacement parts for existing equipment are required in terms of form, fit, and function to maintain reliability and working order of the current system in accordance with Manufacturer Drawing TAS-60 BASIC. The OEM is not registered with SAM.gov, and does not have any Authorized resellers, therefore the Government must procure the Bow Thruster Motor from a third party reseller. Due to these circumstances and the need for the Bow Thruster Motor from the OEM, the acquisition strategy for this requirement will be conducted utilizing Other Than Full and Open Competition as implemented by FAR 13.501(a)(iv).

5. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by

FAR 5.201.

6. Actions to Increase Competition: The Government will post a Pre-Solicitation and Solicitation on the Government Point of Entry (SAM.gov) with a reasonable response time.

7. Market Research: Market research was conducted by the contract specialist and the requiring activity in accordance with FAR Part 8 and FAR Part 10. The Contract Specialist posted a Sources Sought Notice on the SAM.gov website on 4 March 2025 and closed on 7 March 2025 in order to identify any other capable sources to supply the required bow thruster motor. Two businesses responded expressing their interest in providing a quote: 17 Machinery, LLC (CAGE:

3FEG7), a small business concern and GE Energy Power Conversion USA Inc. (4DSJ9), a large business concern. No other potential sources expressed an interest in this requirement. In an effort to identify other potential offerors, the Contract Specialist conducted a review of the marketplace.

Following the review of online contract reporting websites (FPDS-NG, SAM.gov, Electronic

Data Access), it was determined that many sources were potentially capable of supplying the Alconza Berango Bow Thruster Motor.

FPDS-NG search results for “Bow Thruster Motor” produced 46 contract actions awarded to twenty (20) different vendors. Due to the Independent Government Estimate of , contract actions over $250,000 were reviewed. One (1) contract fell above the Simplified Acquisition threshold and was awarded to one (1) company. Due to the limited results, the Contract Specialist conducted another search in FPDS-NG.

FPDS-NG search results for “Thruster Motor” produced 13 contract actions awarded to eleven

(11) different vendors. Due to the Independent Government Estimate of , contract actions over $250,000 were reviewed.

Thirteen (13) contracts fell above the Simplified Acquisition threshold and were awarded to one

(1) company.

As this item is a Critical Safety Item, the Contract Specialist checked the list of N7 qualified sources for Critical Safety Items here: https://www.msc.usff.navy.mil/Business- Opportunities/Contracts/Qualification-for-Items-Critical-to-Shipboard-Safety-on-MSC-Vessels/ and no sources were listed for an Alconza Berango bow thruster motor. The Contract Specialist confirmed this with Assistant Supervisory Engineer via phone call on February 27, 2025.

The Contract Specialist contacted Assistant Supervisory Engineer via email to identify whether the Bow Thruster Motor was part of the Thruster System delivered from Rolls- Royce during the original build of the vessel. His response indicated the Alconza Berango, S.L. Bow Thruster Motor was not part of the Thruster System delivered by Rolls Royce;

therefore, under COMSCINST 4490.1C, MSC N7, and the OEM is Alconza Berango, S.L. The Contract Specialist confirmed Alconza Berango, S.L. (CAGE 0299B) does not have an Active Registration on SAM.gov.

8. Actions to Remove Barriers to Future Competition: The current requirement will be solicited as Other Than Full and Open Competition with Brand Name Justification in accordance with FAR 6.302-1(c). For reasons set forth in paragraph 4(b), NAVSUP FLC Puget Sound has no plans at this time to compete future contracts for this supply in a different manner. If other potential sources emerge, NAVSUP Puget Sound will assess whether further competition for future requirements is feasible. Furthermore, MSC should continue to accept and review submissions from non-brand name contractors for consideration of qualification as an acceptable alternative to brand name. If another potential requirement emerges, FLCPS will assess whether the limitations outlined in paragraph 4 apply still.
