About this file
This is a Brand Name Justification document from the Department of Veterans Affairs for the procurement of Stryker System 9 medical equipment under the Simplified Acquisition Threshold ($250K). The Rocky Mountain Regional VA Medical Center in Aurora, CO is seeking to procure 10 Stryker Small AO Drills, 20 Stryker System 9 Small Batteries, and 40 Stryker System 9 Large Batteries through a firm-fixed price contract.
The justification establishes that only Stryker brand equipment can be used due to compatibility requirements with existing Stryker System 9 Power Tools at the facility. Using different brands would require replacing all existing power tools and accessories at an estimated cost of $1.3 million. The procurement will be solicited as a brand name small business set-aside under FAR Part 13, though it requires a nonavailability waiver for Buy American Act compliance since items are manufactured in China. Market research through VetCert, DSBS, and SCMC confirmed the items can only be purchased through Stryker or authorized distributors.

require a nonavailability waiver due to the items not being compliant with the Buy American Act. In addition, the VA Rule of Two cannot be met because the SDVOSBs do not meet the Nonmanufacturer Rule (NMR) and Limitations on Subcontracting (LOS) requirement as the original equipment manufacturer (OEM) is a large business. NMR and LOS do not apply to small business set-asides under the Simplified Acquisition Threshold (SAT). This requirement will be solicited as a brand name small business set-aside in accordance with FAR Part 13.
