NSWCCD Sole Source/Brand Name Justification SAT rev 1 Effective September 2020
USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN
SIMPLIFIED ACQUISITION THRESHOLD MEMO
FROM:
CODE: 863
SUBJECT: Sole Source Justification for Kollmorgen Submersible Motor and Cables
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.
II. DESCRIPTION OF ITEM OR SERVICE
NSWCCD Code 863 requires the purchase of an additional Kollmorgen submersible motor and cables to support captive model submarine hydrodynamic testing. Existing infrastructure will only support a single test simultaneously, and upcoming testing to support the SSN(x) program will require testing two simultaneously.
Code 863 requires the additional motor and cables to be identical and interchangeable with the existing hardware and software to avoid incompatibilities when components are exchanged between models. The submersible motor must be purchased to support future captive model testing by .
III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
Market research through web search, manufacturer catalogs, and distributor sales representatives has shown that there are submersible motors with similar capabilities to the Kollmorgen motor. However, these motors have different dimensions which would require adapting hardware to be manufactured to interface to existing systems in the captive hydrodynamic submarine models. Additionally, they require different interfacing connectors which would not be compatible with existing equipment. Last, the motors have different physical properties which would require changes to the motor control loops. All of these differences would require time and expense compared with integrating an identical component.
A. BRAND NAME:
Item required must be a brand name product, or feature of a product, particular to one manufacturer.
1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).
3. Other Reasons:
Existing infrastructure such as cabling, connectors, software, power, and motor controllers support a previously purchased submersible Kollmorgen motor. The purchase is for an identical copy of that motor. Any change to the motor would require additional purchases and labor to ensure that the captive submarine hydrodynamic models are compatible with the new equipment. Additionally, software would require changes to interface with a different system and the different physical properties of the motor would require re-tuning control loops if the motors were ever changed. Since the two motors will be supporting at least four different captive models, with up to two operational simultaneously, the motors will be frequently moving between models, increasing the importance of keeping the hardware identical.
B. SOLE SOURCE (select all that apply)
1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. Other Reasons:
IV. CERTIFICATIONS & APPROVALS
A. Technical/Requirements Certification: I certify that the facts and representation under my cognizance, which are included in this justification, are complete and accurate to the best of my knowledge and belief.
