About this file

This is a Justification for Brand Name Awards document submitted by the Department of Veterans Affairs under RFO 6.103 for a procurement over the micro-purchase threshold but not exceeding the simplified acquisition threshold.

VA Northern California Health Care System (VANCHCS) seeks to procure replacement surgical instruments for podiatry/surgical service to replace items damaged between November 2025 and February 2026. The required items comprise a complete Stryker BPX Surgical Instrument Set, including saws, drills, batteries, chargers, and related components totaling 12 part numbers with quantities ranging from 1 to 4 units. The justification explains that VANCHCS has already directly purchased three specific Stryker-brand components (BPX Micro Drill, Oscillating Saw, and AO Small Drill) and requires the remaining items to complete the integrated set, as no compatible alternatives exist that maintain functionality, performance, and warranty integrity. Market research was conducted across multiple sources including SBA's Dynamic Small Business Search (which identified 981 SDVOSB/VOSB vendors), VA National Acquisition Center, VA Analytics platform, GSA Advantage, and USASpending.gov, all yielding no results for the specific part numbers. The Original Equipment Manufacturer (Stryker Customer Solutions) identified two authorized resellers—Trillamed LLC and Beacon Point Associates LLC, both certified as SDVOSBs. The document recommends a small business set-aside under RFO Part 12 and 19 given the reasonable expectation of offers from small business concerns, though the VA Rule of Two cannot be met due to the Nonmanufacturing Rule. The procurement is anticipated to be fair and reasonable based on competition, with provisions for future market surveys to determine if brand-name restrictions can be lifted. Acquisition ID# 36C261-26-AP-4850; JOFOC Tracking Number: FY26 - NCO 21 - 2243; Purchase Request Number: 612-26-4-154-0414; Effective Date: 12/30/2025.

VA Northern California Health Care System (VANCHCS) requires the purchase of replacement Surgical Instruments for Podiatry/Surgical Service. As per VANCHCS, instruments processed from November of 2025 to February of 2026 were damaged and are now unsuitable for Surgical use.

VANCHCS has placed a purchase with Stryker Customer Solutions (dba Stryker Sales LLC) directly for the procurement of Three (3) of the needed replacement items – One (1) each, BPX Micro Drill;

One (1) each, Oscillating Saw; and One (1) each, AO Small Drill. As per Stryker Customer Solutions (dba Stryker Sales LLC), these three items are all Stryker-Brand components that are sold as individual parts; however, they are required to complete the larger BPX set needed. There are no compatible alternatives authorized and/or available that can integrate with the set without affecting functionality, performance, and/or warranties, etc. associated. Therefore, this will be a Brand Name procurement for the remaining items needed to secure a complete set of Stryker BPX Surgical Instruments for the Podiatry Service at VANCHCS.

4. Description of market research conducted and results or statement why it was not conducted:

The Nonmanufacturing Rule does not apply to small business set-aside acquisitions with an estimated value between the micro-purchase threshold and the simplified acquisition threshold; however, it does apply to all set-aside acquisitions under the 8(a), HUBZone, SDVOSB, VOSB, and WOSB programs.

The Limitations on Subcontracting do not apply.

There are no special practices and / or standards of note; standard commercial regulations apply.

The Food and Drug Administration (FDA) regulates medical devices sold in the United States to assure their safety and effectiveness. Items purchased for use at the Department of Veterans Affairs must be FDA approved.

Used the Small Business Administration’s (SBA) Dynamic Small Business Search (DSBS) to identify certified capable SDVOSBs and VOSBs.
