3_ Statutory Authority Permitting Other Than Full and Open Competition_ The statuto1y authority pe1mitting other than full and open competition is 41 U.S.C.3304(a)(l ), as implemented by Federal Acquisition Regulation (FAR) 6.302-l(c) Only one responsible source and no other supplies or se1vices will satisfy agency requirements.

4- Identification of the justification rationale_ The acquisition is being conducted under the procedures of FAR 13.106(b)(l)(i)- Soliciting from a single source, i.e. brand-name. The justification rationale for restricting competition is that the required drone is manufactured by, and proplietaiy to Panot. The ANAFI drones are compliant with DoD policy and federal regulations.

NCIS already has integrated the softwai·e needed to utilize the drones.

NCIS requires eight (8) Small COTS UAS with an EO and IR camera systems that can be procured and operated under cunent DoD requirements to allow use with DroneSense platfo1m and Pix4D software already in se1vice with TSFO.

Estimated total value is- Delive1y: 120 days ADC.

6. Specific characteristics of the material or service that limit the availability to this/these source(s) (unique features, function of the item, etc.). Describe in detail why only this/these suggested source(s) can furnish the requirements to the exclusion of other sources. Provide a description of the market research conducted among schedule holders.

Initial Market Reseai·ch was conducted by the Requirement Owner (RO), through attendance at Association of Unmanned Vehicle Systems (AUVSI), National Technical Investigators Association

(NATIA), and Airborne Public Safety Association (APSA) conferences. The RO also has appeared before the DoD and DoN Commercial Off The Shelf (COTS) Unmanned Aerial Systems (UAS) exemption boards, and teaches the NATIA UAS operators’ course. Through all of these events and activities, the RO has been able to gain the knowledge and expertise of the current state of COTS UAS for use with DoD and the DoN. The Contract Specialist verified with the manufacturer that there are multiple authorized small business resellers capable of fulfilling this requirement.

7. Other information to support a brand name buy:

The NCIS UAS program operating permissions require coordination between NCIS, NAVAIR, NAVSEA and the FAA. The current pilots are trained and use Parrot ANAFI aircraft. Additional Parrot ANAFI aircraft will allow for an expansion of an already existing fleet of Parrot ANAFI systems that are fielded by NCIS to new pilots with the newer and more capable, but operationally similar, ANAFI UKR system. Utilizing the same aircraft would allow for a consistency of operation and continuity of meeting ongoing training requirements to allow faster operational utilization than if a switch to a different manufacture was made that would necessitate new training to occur.

Parrot is the sole manufacturer for this requirement with multiple authorized vendors to sell the approved edition of the Parrot Anafi UKR that meets NDAA, TAA, DoD and DoN Cybersecurity requirements.
