About this file
This is a Justification and Approval (J&A) document for a sole source, brand-name acquisition by the Naval Criminal Investigative Service (NCIS) for Dell workstations. NCIS Cyber Code 20 requires 61 Dell workstations for cyber investigations and operations, specifically 50 Dell Pro 16 Plus Base, 10 Dell Pro Max Slim Base, and 1 Precision 3680 Tower CTO Base, to be procured in Fiscal Year 2025. The acquisition is justified based on the unique technical requirements that only Dell Federal Systems L.P. can meet, including TAA compliance, ISO 9660 certification, and compatibility with existing NCIS system infrastructure and operational networks.
The procurement will be conducted under FAR 16.505(b)(2)(i)(G) with the statutory authority of 10 U.S.C. 3204(a)(1), citing "Only One responsible source and no other supplies or services will satisfy agency requirements." Market research was conducted using GSA and NASA SEWP contract vehicles, which identified multiple potential small business resellers. The requested award date is 16 July 2025, with delivery requested no later than 15 August 2025. The agency commits to conducting market reviews in future procurements to maximize competition and reassess mission needs.

5. Rationale Justifying Use of Cited Authority. The acquisition is being conducted under the procedures of Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(G) – Exceptions to the fair opportunity process. The justification rationale for restricting competition is: Dell Federal Systems, L.P. is the only manufacturer whose products meet the technical requirements. NCIS’ Cyber Capabilities Integration office, Code 20C, requires TAA-compliant, Dell workstations from an ISO 9660 certified supplier. Cyber needs to maintain consistency in the equipment used in conducting investigative and operational support, and procuring these workstations will allow Cyber to maintain one equipment baseline which ultimately ensures stability, interoperability, compatibility and uniformity. If another brand of workstations were to be procured, Cyber analysts and agents would be required to have different vendor support to address workstation issues which could result longer lead times and additional repair costs. Additionally, non-Dell workstations will introduce compatibility issues caused by system driver and firmware mismatches for the Linux and Windows operating system baselines that Cyber maintains for deployment.
6. Specific characteristics of the supplies or services that limit the availability to this/these source(s), i.e., unique features, form-fit-function, etc.). State why the requested material or service represents the minimum requirement(s) of the Government. Describe in detail why only this/these suggested source(s) can furnish the requirement(s) to the exclusion of other sources.
Cyber requires Dell brand workstations to be integrated into Cyber’s data collection and analysis network. To ensure compatibility with current systems and to be able to meet the high processing speeds and data storage needs required for the Cyber mission. The proposed acquisition is to purchase TAA-compliant, OEM workstations from an ISO 9660 certified supplier. Cyber needs to maintain consistency in the equipment used in conducting investigative and operational support, and procuring these Dell workstations will allow the Government to maintain one equipment baseline which ultimately ensures compatibility and uniformity – each of which allows for streamlined development, training, equipment maintenance, and deployment. Implementing non-Dell-based hardware into the existing system infrastructure would require special coding and redesigning of both the application and the system – all of which would increase risk of system downtime, as well as increase government costs for buying lower volumes of replacement parts (i.e., no economies of scale realized) and increased training, documentation, and development requirements. These Dell workstations are the only items that are compatible with the existing NCIS system infrastructure. No other source offers products that will be compatible with the existing equipment; and thus, satisfy the Government’s minimum requirement. Therefore, the proposed acquisition can only be fulfilled by the items outlined in Section 3 – all of which are manufactured by Dell Federal Systems L.P.
7. Determination of fair and reasonable pricing.
Basis of award will be determined for fair and reasonable pricing using techniques at FAR 13.106- 3(a), as applicable.
8. Brief description of Market Research conducted and results or why market research was not conducted.
Acquisitions Code 14B based market research on searching the GSA and NASA SEWP contract vehicles as preferred sources of supply. Required sources UNICOR, AbilityOne, and DoD ESI did not have any of the required items. Code 14B researched the identified components and found multiple sources in both GSA Advantage and NASA SEWP – many of these sources being small-businesses. The decision was made to competitively solicit in NASA SEWP under NAICS 334111.
