BRAND NAME JUSTIFICATION

SIMPLIFIED ACQUISITON

1. General Contract Information.

Contracting Activity: AFLCMC/HNCKA

Purchase Request: T BD

Project/Program Name: VINSON/Advanced Narrowband Digital Voice Terminal (ANDVT)

Crytographic Modernization (VACM) Software Depot

Estimate Contract Cost: $40,000.00

2. Description of the Supplies/Services Required.

This requirement will result in a Firm Fixed Price Delivery Order to procure MontaVista

Linux 6, which is a embedded system development platform used to develop, build, and maintain components of VACM software. This product includes the operating system and integrated development tool chain for the specific VACM hardware, which was used to develop the original software.Vendor maintenance support is also required for product technical support. The requirement will be solicited by other than full and open competition.

3. Justification/Rationale for Procuring Brand Name.

MontaVista is the original manufacturer, and the only authorized distributor for MontaVista software is Phoenics Electronics Corporation. MontaVista offers a complete development platform for embedded ARM/DSP architecture of the VACM system including proprietary and open source tool chain components not available in any other product. The existing legacy

VACM software build process is dependent on the MontaVista product to the extent that the lack of this product would prevent the VACM software depot from carrying out its core mission of providing ongoing maintenance of the software.

This requirement will be procured using 3400 appropriations.

4. Efforts to Obtain Competition.

Brand name market research was previously conducted by checking the Department of

Defense (DoD) Enterprise Software Initiative (ESI) along with using previous acquisition history. An inquiry was conducted on DoD’s mandatory source ESI and resulted in the product not being available. A product search in GSA Advantage revealed this product is not available. An inquiry was conducted on US Air Force’s mandatory source for IT products, GSA 2nd Generation IT Products (2GIT) blanket purchase agreement and resulted in product not being available. Further market research reveals only one known vendor (Phoenics

Electronics Corporation) is authorized distributor for the MontaVista software, and therefore is the only source that can meet the Government’s requirement.

5. Efforts to Preclude Future Brand Name Awards.

The VACM Software Depot will continue to actively search the marketplace for potential future vendors/resellers. If future products become available, they would require review/approval by the Agency.

6. Contracting Officer’s Determination.

I have determined, in accordance with FAR 16.505(a)(4), that the circumstances of this contract action justify the procurement of brand name items peculiar to one manufacturer.
