About this file
This document is a brand name justification for a simplified acquisition under the simplified acquisition threshold for the Department of Veterans Affairs. The Martinsburg VA Medical Center requires the procurement of seven each of MGC Diagnostics CPFS/D USB Spirometers with BreezeSuite Software, mobile carts, laptop computers, printers, and multiuser installation and training. The estimated value is $250,000. Procurement of MGC Diagnostics products is justified due to compatibility with existing equipment and software at the medical center, as well as cost considerations regarding warranties, repairs, and maintenance of new and existing equipment. Market research identified two potentially qualifying SDVOSBs but they did not meet the criteria of 13 CFR 121.406(b)(1) for non-manufacturers. The justification supports a sole source award under the VA's Federal Supply Schedule to the incumbent vendor, MGC Diagnostics, for these requirements.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
It is in the best interest to procure brand name MGC Diagnostics products due to cost related to warranties, repairs, maintenance, etc. to new and existing equipment. Accordingly, their items are currently utilized at the Martinsburg medical center and interfaced with CPRS. Equipment must be compatible with existing MGC server and interface. Procuring MGC Diagonostics products are offers the an opportunity to procure the requirement without the Veteran’s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition.
4. Description of market research conducted and results or statement why it was not conducted:
For market research, two separate searches were conducted on the VIP database for the SDVOSBs and VOSBs who could potentially fulfill the requirement. Based on the search criteria used, two SDVOSBs and no VOSBs were found. Out of the two SDVOSBs that were found, they do not qualify for a set-aside due to not meeting all the criteria listed for non-manufacturers in 13 CFR 121.406(b)(1). With the following information, the VA Rule of Two cannot be met. One vendor (MGC Diagnostics) has an active VA FSS schedule. There is no NMR class waiver for NAICS 339112 for spirometers.
