3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
It is in the best interest to procure brand name Hologic, Inc products due to the requirement needing to be compatible with existing Hologic, Inc items currently utilized at the Martinsburg VA medical center. Acquiring Hologic, Inc products offers the opportunity to procure the requirement without the Veteran’s Health Administration experiencing substantial duplication of cost related to warranties, repairs, maintenance, etc. to new and existing equipment that could not be expected to be recovered through competition.
4. Description of market research conducted and results or statement why it was not conducted:
A search was conducted using the VIP database and found no SDVOSBs or VOSBs using the search criteria NAICS 339112 and keywords “Fluid Management System”. The program office received an informal quote from the manufacturer Hologic, Inc. for the fluid management system. The estimated value is . The manufacturer was also contacted to request information about their authorized distributors. They responded with three contractors; 1) DGA Medical, a SDVOSB; 2) Sustainment Technologies, LLC, a SDVOSB; 3) Red Heritage Medical a Native American Owned small business. The SDVOSBs do not qualify for a set-aside due to not meeting all the criteria listed for non-manufacturers in 13 CFR 121.406(b)(1). For the NAICS code 339112, Fluid Management System do not fall under the SBA Non-Manufacturer rule class waiver list. With the following information, the VA Rule of Two cannot be met.
