BRAND NAME JUSTIFICATION

1. Contracting Agency and Activity. The Department of the Interior, United States Geological Survey plans to contract by means other than full and open competition. This document sets forth the justification and approval for award of an underwater acoustic system on a limited source basis as required by FAR 13.106-1.

2. Nature of Action Being Approved. New Firm Fixed Price for procurement of Lubell Labs underwater acoustic system.

3. Description of Supplies or Services. The U.S. Geological Survey, Columbia Environmental Research Center (CERC) requires an underwater acoustic system to research and develop acoustic deterrents for bigheaded carp. The system must include:

· 20- LL916C-IE (PRO) underwater speaker

· 20- AC205B (PRO) transformer box with screw terminal connections

4. Statutory Authority. The proposed action may be awarded on a sole source basis under the authority of Section 201 of the Property and Administrative Services Act of 1949 (40 USC 501) and FAR 13.106-1.

5. Rationale Supporting Use of Citation in No. 5. Lubell Labs Inc. meets the Government’s minimum requirements. In addition, Lubell Labs Inc. components readily integrate with the existing capital of Lubell Labs Inc equipment owned by USGS, in the amount of $90,000.00, as well as the platform of ongoing research and development of acoustic deterrent systems among collaborators. If a different manufacture was used, the data would be measured differently, which causes inconsistences in studies. No other Company can supply components that are compatible with Lubell Labs due to proprietary components.

6. Other Information. N/A

7. The Efforts to Identify Additional Sources Including the Market Research Conducted. Market research, via the Internet, competition will be available among resellers. Also, in preliminary research of the Internet, it was determined that Lubell Labs underwater acoustic systems is the only available equipment compatible with existing Government-owned equipment.

8. Actions to Overcome Barriers to Competition. All brands and vendor instrumentation with the ability to provide consistently high-quality equipment for current and future studies will be considered. Future requirements for same/similar items will be competed to the maximum extent practical.

9. Recommendation and Certification from Program Office Based on the above, I recommend this acquisition be conducted on a limited source basis. I certify that technical data which form a basis for this justification, that are the responsibility of technical or requirements personnel are complete and accurate.
