About this file
This is a Justification for Single Source Award document from the Department of Veterans Affairs for a brand name only procurement over the micro-purchase threshold but not exceeding the Simplified Acquisition Threshold (SAT).
The San Francisco VA Medical Center, under Network Contracting Office (NCO) 21, is procuring a Leica M320 microscope with accessories and on-site installation/calibration services. The required equipment includes a floor stand, power cable, top plate, dust cover, lateral handles, optics carrier with swing arm, inclined binocular tube, eyepieces, multifocus objective lens, and installation services. The justification establishes that the Leica M320 is the sole source capable of meeting the facility's operational and technical requirements due to its unique combination of features: manual APOchromatic 5-step magnification (6.4×–40×), integrated dual LED illumination, UV- and IR-free illumination, MultiFoc objective lens with variable working distance (200–300 mm), and integrated 4K imaging and photo documentation capabilities. Comparable systems from Zeiss and Olympus lack this specific feature combination. The SF VA research laboratory already operates an existing Leica M320, and procurement of a second unit will enable parts interchangeability and eliminate training requirements.
Market research confirmed that Melling Medical LLC is the sole authorized distributor of Leica microscopes to the Government through an OEM letter from Leica Microsystems Inc., though the manufacturer also sells directly to the Government. Searches across SAM.gov, VA Supply Chain Master Catalog, GSA Advantage, and the NAC revealed no existing contracts for the M320, and both Leica and Melling confirmed this would be an open market purchase. Despite identifying 2,631 small businesses under NAICS 333310, no other authorized distributors exist. The procurement will be competed unrestricted for size as a brand name only requirement between the large business OEM and the SDVOSB distributor, as the Non-Manufacturer Rule would prohibit a sole source award to the SDVOSB given the availability of a large business OEM alternative.

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office
(NCO) 21, Veterans Integrated Service Network (VISN) 21, San Francisco VA Medical Center, 4150 Clement Street, San Francisco, CA 94121-1563 2237:
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This is a new brand name only, firm fixed price requirement for a Leica M320 microscope and accessories to include the following:

The estimated price for this procurement is .
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This is a brand name only requirement. The Leica M320 features a manual APOchromatic 5-step magnification changer (6.4×–40×), integrated dual LED illumination within the optics carrier, UV- and IR-free illumination, and a MultiFoc objective lens with a variable working distance of 200–300 mm. These features provide consistent illumination, improved color accuracy, and enhanced visualization during high-detail surgical and research procedures. Also, the Leica M320 offers integrated 4K imaging and photo documentation capabilities directly within the system, helpful for teaching, Revision: 02 Effective Date: 12/30/2025 Page 2 of 2 Acquisition ID# presentations, and publication. Comparable systems reviewed from Zeiss and Olympus did not provide the same combination of integrated APOchromatic optics, dual integrated LED illumination, adjustable working distance, and 4K imaging functionality required for this application. Only the Leica M320 is known capable of meeting all operational and technical requirements of this procurement. Additionally, the SF VA research laboratory has an existing Leica M320 and accessories.
Procurement of a second unit will allow for interchange of parts and immediate use of items without the need to procure training on a new device.
4. Description of market research conducted and results or statement why it was not conducted: Melling Medical LLC provided market research pricing for the necessary unit and accessories as well as a letter from Large Business Original Equipment Manufacturer (OEM), Leica Microsystems Inc., stating Melling is the sole authorized distributor of Leica microscopes to the Government. A review of GSA E-library for Leica Microsystems confirmed that the OEM also sells microscopes directly to the Government which allows for procurement of the M320 to be competed between the large business OEM and SDVOSB distributor. Searches were conducted across SAM.gov, the VA Supply Chain Master Catalog, GSA Advantage and the NAC. No existing contracts could be located to include the M320 microscope and both Leica and Melling have confirmed a purchase of this model would be Open Market. While a search at the SBA Small Business Search resulted in 2,631 small businesses under NAICS 333310, the sole source letter from Leica confirms there are no authorized distributors of any size or socioeconomic standard beyond Melling Medical LLC. The Non-Manufacturer Rule will not apply as no set aside can be held but would prohibit a sole source to the SDVOSB given a large business OEM. With one large and one SDVOSB vendor known capable of providing the necessary equipment, this shall be competed unrestricted for size as a brand name only requirement.
5. Contracting Officer's Certification: Purchase is approved in accordance with RFO
12.102(a). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
