About this file
This document is a Brand Name Justification that outlines the rationale for a sole-source acquisition of two Lochinvar high efficiency commercial water heaters, model AWH0500NP, for the Federal Correctional Institution (FCI) in Greenville, Illinois.
The water heaters are required to tie into the existing system and controllers at FCI Greenville. The agency determined that the Lochinvar brand is the only practical solution to repair the facility's hot water system, as the existing equipment is designed to work specifically with Lochinvar components. The justification cites the statutory authority under FAR 13.106-1(b)(1)(i) for contracting with a single source due to the unique requirements and compatibility needs. The brand name solicitation is being publicly advertised to allow for maximum competition from qualified vendors.

NON COMPETITIVE MEMORANDUM
FOR SIMPLIFIED ACQUISITION ACTIONS
IAW FAR 13.106-3(b)(3)
1. REQUIRING AGENCY – DOJ/Bureau of Prisons FCI Greenville, 100 US-40 Greenville IL. 62246
2. NATURE/DESCRIPTION OF ACTION BEING APPROVED – Brand Name/Exact Match
3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS:
The agency requires two (2) commercial hot water boilers. These boilers must tie in to the existing system and controllers.
4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION – 41 U.S.C. 3304(a)(1) and FAR 13.106-1(b)(1)(i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE
NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED:
FCI Greenville is currently replacing components of its hot water system in two if its housing units. FCI Greenville utilizes 2 Lochinvar high efficiency commercial water heaters model AWH0500NP to heat the water in each of its housing units. The water heaters are wired together and work together to achieve maximum efficiency. Both heaters feed Lochinvar tanks. The heaters controls are designed to be used with Lochinvar tanks. The Flu pipes are piped together as well. The water piping is balanced to feed both heaters. There is not another practical solution to making the needed repairs to Greenville water heaters other than purchasing Lochinvar high efficiency commercial water heaters model AWH0500NP.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY
POTENTIAL SOURCES AS PRACTICABLE:
The brand name solicitation is being published to the public government point of entry to allow for maximum competition for those who are able to provide the required equipment.
CONTRACTING OFFICER’S CERTIFICATION
I certify this justification is accurate and complete to the best of knowledge and belief.
