JUSTIFICATION AND APPROVAL FOR

Brand-Name in accordance with

FAR Part 13.501

1. Contracting Agency:

The U.S. Army Corps of Engineers (USACE), Vicksburg District (MVK) Contracting Office (CT), 4155 Clay Street, Vicksburg, MS 39183-3435.

2. Description of Action:

This Justification and Approval (J&A) seeks approval to procure certain brand name parts for the supply and delivery of Exxon Mobil Gard 410 NC (preferred product), or Chevron 710 LE 40 oils for the Dredge Jadwin main engines during the 2025 dredging season. This action is estimated to purchase up to $334,375.00 of oil over a two-year period.

3. Description of Supply/Service:

The USACE MVK requires a contractor to provide all plant, labor, equipment, materials, and supplies necessary to furnish and deliver (over the life of the contract) up to 25,000 gallons of Exxon Mobil Gard 410 NC (preferred product), or Chevron 710 LE 40 in increments averaging 2,000 gallons per shipment Oil shall be provided on an as needed basis as instructed by the USACE Technical POC. The contractor shall bill the Dredge Jadwin for the oil at the market price per gallon plus the binding markup rate. All work shall be completed in accordance with the Scope of Work.

4. Authority Cited:

Authority for use of procedures other than competitive procedures is provided at Title 10 United States Code 3204 (a)(1) as implemented by Federal Acquisition Regulation (FAR) 13.501(a)(2)(ii).

5. Reason for Authority Cited:

The Dredge JADWIN requires the Exxon Mobilgard 410 NC or Chevron 710 LE 40 oils. It is highly recommended to using these brands of oil because different oils can have different chemical compositions and additives that, when combined, may not work as well together and could potentially damage an engine by decreasing the effectiveness of lubrication or producing unstable mixtures. The high quality of these recommended oils will allow the Dredge JADWIN to ensure the best performance and protection for its main engines, in addition to cutting costs. Additionally, the personnel operating this vessel are familiar with the brands. As a result, it will be advantageous for the government to consider these products, as different brands will offer considerable risks.

6. Market Research was conducted using the Dynamic Small Business Search (DSBS) and previous procurement history to determine the type of set-aside that best fits this acquisition.

The results are detailed below:

- HUBZone Program – No HUBZone Certified Small Businesses were identified with the capability to meet the requirement’s need.
