About this file
This is a Justification for Brand Name Products submitted by the National Park Service's Contracting Operations - Central office, dated February 19, 2026. The National Park Service seeks to procure two (2) Volvo Penta Aquamatic Drives, Manufacturing Part Number 23548865, for the NPS Munson Landing Craft Vessel. The justification establishes that only one responsible source exists for this requirement, as the outdrives are proprietary to Volvo Penta and represent the only product compatible with the vessel's current Volvo Penta D6-310 engine without requiring modifications to the mount or transom. The estimated contract value is under $50,000.
The contracting office conducted market research confirming that no alternative outdrive products on the market would fit and function with the existing engine without creating safety hazards or requiring costly vessel modifications. Failure to acquire the specified brand name product could render the vessel inoperable, prevent NPS personnel from carrying out their mission, and expose the Government to liability and additional repair costs. The acquisition is authorized under 41 U.S.C. 253(c)(1), FAR Part 11.105, and FAR 6.302-1, which permit non-competitive procurement when brand name products are essential to agency requirements. The solicitation will be posted on sam.gov for acquisitions over $25,000. Two interested sources are identified: Mobile Marine Service (East Jordan, MI) and Marine Parts Source (Sun Prairie, WI). The justification was certified by Jennifer Miller, Island Maintenance Supervisor, and Jarrod Brown, Contracting Officer, both on February 19, 2026.

Justification for Brand Name Products
Date: 2/19/2026
Project: SLBE – LCV Volvo Penta Outdrives
1. Identifications
a. Agency: National Park Service
b. Contracting Office: OH Major Acquisition Buying Office
2. Description of the action being approved:
The National Park Service (NPS) shall be soliciting for qty. 2 (two) Volvo Penta Aquamatic Drives, MFG Part # 23548865.
The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR).
3. Description of supplies and services: Qty. 2 (two) Volvo Penta Aquatmatic Drives, MFG Part # 23548865 for the NPS Munson Landing Craft Vessel.
4. Authority:
a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.
b. FAR Part 11.105: The Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.
c. FAR 6.302-1: The use of the name brand products are essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
5. The description of the product’s unique qualifications or the unique nature of the acquisition: Volvo Penta Aquatmatic Drives, MFG Part # 23548865 are unique to the manufacturer and are the only available product that will be compatible with the Munson Landing Craft Vessel’s current power source, a Volvo Penta D6-310 engine, with no modifications to the mount or transom.
6. Efforts to obtain competition:
a. Efforts to ensure offers are solicited from as many potential sources as is practicable:
For acquisitions over $25,000 the solicitation will be issued on the Government’s Point of Entry, sam.gov.
b. Presolicitation notice per FAR 5.2:
For acquisitions over $25,000 a presolicitation notice shall be posted on the Government’s Point of Entry, sam.gov unless the exception noted at FAR Part 5.202(a)(13) applies.
7. Determination that costs will be fair & reasonable: Quotes will be determined fair and reasonable by competition as well as comparison of established and advertised market prices. The outdrives are a commercial off the shelf product and comparative pricing is widely available.
8. Description of the market research conducted: The requiring activity researched the requirement and confirmed that the outdrives for the Volvo Penta D6-310 engine is proprietary to the manufacture and no outer outdrive on the market would be compatible with the existing engine without further modifications to the mount or transom.
9. Other facts supporting other than full & open competition:
a. Reason why documents suitable for full & open competition have not been developed: Any similar product on the market simply would not fit and be compatible with the existing Volvo Penta D6-310 engine.
b. Data, estimated costs or other rationale as to the extent or harm to the Government: failure to acquire this brand name product could render the Munson Landing Craft Vessel inoperable and would prevent NPS personnel from carrying out their mission affecting the safety of experience of visitors to the Lakeshore. Furthermore, the use of any other product would require modifications to the vessel’s mount or transom, potentially creating a safety hazard or damage to the engine. The Government could be exposed to further costs to repair or replace the engine as well as unlimited liability from potential safety risks.
