Determination that Only One Source is Reasonably Available (Including Brand Name)- FAR Part 13 Acquisitions under the SAT
MCIEAST utilizes fiber optic cables manufactured by Corning and Preformed Line Products throughout their communications network which is responsible for all communications on base to include emergency services like 9-1-1. This purchase is to procure direct replacement parts for these manufactured cables.
While third-party replacement parts can be used on the cables, historically those parts have not lasted as long as the OEM manufactured parts. The continuance of buying third-party replacements parts continually costs MCIEAST G6 on average $50,000 or more a year to procure. Replacing existing fiber optic cables with new manufactured cables is also not a feasible course of action as that would cost MCIEAST G6 millions of dollars to complete.
C. _URGENT AND COMPELLING. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
