DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Lower Colorado Basin, Acquisition and Assistance Management Office.

2. Name and Address of Single Source. This is a brand name requirement for OPTO 22

SNAP-PAC-R1.

3. Description of Supplies/Services and Estimated Cost. The Yuma Area Office has a requirement to replace existing end of life equipment. The current equipment will be replaced with OPTO 22 SANP-PAC-R1 units. Delivery is expected to be within 60 days after receipt of order and the estimated cost is $79,800.0.

4. Description of Circumstances, including why only one source is reasonably available.

The Bureau of Reclamation’s Yuma Desalting Plant (YDP) and Water Quality Improvement Center (WQIC) employ the use of OPTO 22 SNAP-PAC-EB1 controller/brain and OPTO 22 branded input/output (I/O) module accessories. The SNAP-PAC-EB1 model has reached obsolescence as of March 01, 2022. OPTO 22 offers the SNAP-PAC-R1 model as the sole commercial off the shelf (COTS) replacement. To maintain continuous operations at the YDP and the WQIC, OPTO 22 SNAP-PAC-R1 units are needed as stock replacements for the SNAP-PAC-EB1 units. The SNAP-PAC-R1 units are compatible with the existing OPTO 22 I/O modules used throughout the YDP and the WQIC so parts can be easily swapped and replaced. No other third-party product exists commercially that can offer seamless operations with the existing OPTO 22 I/O modules. The planning, engineering, design, development, and manufacture of an alternative third-party product would be cost prohibitive and risk the loss of seamless performance with the existing OPTO 22 branded products that are currently installed at the YDP and the WQIC.

5. Determination of Fair and Reasonable Price.

The anticipated cost will be considered fair and reasonable based on competition and price analysis techniques at FAR 13.106-3(a)(2)(iii) current price lists, catalogs, or advertisements and (vi), comparison to an Independent Government estimate.

6. Description of Market Research. Market research was conducted by the Contract Specialist to determine if the requested equipment could be provided by other distributors.
