About this file

This document is a justification for an exception to fair opportunity or to use brand-name restriction for a federal contract opportunity with the Department of the Air Force Air Combat Command. The justification specifies the need to procure a piston assembly from the original equipment manufacturer due to requirements for first article testing approval, standardization of systems for reduced costs, and lack of usable cores to meet overhaul requirements for BAK-12 brake and clutch assemblies at Tyndall Air Force Base. The related solicitation is for a piston assembly for BAK-12 aircraft arresting barriers at Tyndall Air Force Base, with solicitation number FA481924QA006. The program manager and contracting officer certify that the justification is accurate and complete.

Justification for an Exception to Fair Opportunity or to Use Brand-Name Restriction

(6) Other facts supporting the justification:

Any company/product provider that is chosen must be First Article Testing (FAT) approved.

Another manufacturer’s piston assembly will have to be tested for form, fit, finish, function and configuration conformity at the expense of the Air Force and manufacturer prior to being qualified/approved as a suitable substitute or replacement item by the AAS Engineer at Robins AFB GA. Failure to continue with standardization of these systems will have significant long-term impacts to strategic goals for reductions of operational costs, spare provisioning costs and increased integration costs for non-standardized piston assembly. The lack of usable cores required to meet the technical order mandated ten-year overhaul of BAK-12 brake and clutch assemblies are the driving factor for the procurement of the piston assembly, arresting barrier and delays Tyndall CEMIRT’s AAS overhaul program and mission.

(7) Actions the agency may take to remove or overcome any barriers to decreasing the use of brand-name items before any subsequent acquisition of the supplies or services:

The user and contracting agency will continue to survey the market place to locate any new prospective brands and contractors who are able to provide the needed requirement.

(8) Program Manager's certification that supporting data is accurate and complete:

As evidenced by my signature below, I certify that any supporting data contained herein, which is my responsibility, is both accurate and complete.

(10) Approving Official's determination that FAR16.505(a)(4)(i) applies to the order:

As evidenced by my signature below, I hereby determine that the use of brand-name restriction applies.
