About this file

This Brand Name Justification document outlines the need to acquire two Carrier brand 30-ton air-cooled chiller units and associated parts from Carrier to replace existing chillers supporting critical Navy operations at a naval base in San Diego. The existing HVAC infrastructure was designed around Carrier chillers to ensure seamless operation and maximum efficiency. Introducing a different chiller brand could compromise the overall system reliability and efficiency as Navy maintenance staff have been extensively trained on Carrier units. Market research found no other qualified sources able to meet the requirements. The General Services Administration will conduct the acquisition under solicitation number 47QSEA-23-Q-0283 to seek price reductions prior to issuing the order.

4. IDENTIFICATION OF JUSTIFICATION RATIONALE

The circumstances and rationale for limiting consideration to select schedule contractors for award follows:

This acquisition is conducted under the authority of Federal Acquisition Regulation, (FAR)

13.501(a). This subpart authorizes the use of simplified procedures for the acquisition of supplies and services in amounts greater than the simplified acquisition threshold but not exceeding $7 million ($13 million for acquisitions as described in 13.500(c)), including options, if the contracting officer reasonably expects, based on the nature of the supplies or services sought, and on market research, that offers will include only commercial items. However, in accordance with FAR 13.501(a), an ordering activity must justify its action when restricting consideration to a single source. Additionally, this limited source justification will document that this requirement is essential to the Government’s requirements and the market research which indicates that no other brand is qualified to meet the Navy’s requirements.

5. DEMONSTRATION OF THE UNIQUE NATURE OF THE REQUIRED SUPPLY

The existing HVAC infrastructure relies on an integrated HVAC system that includes various components and equipment from Carrier. The system was carefully designed and implemented with a Carrier chiller in mind, ensuring seamless operation and maximum efficiency.

The Carrier chiller has proven to deliver consisten and reliable performance over the yeaers, ensuring a stable environment for our critical operations. Any deviation from the established compatibility could compromise the overall system’s efficiency and reliability.

Additionally, Navy maintenance personnel have received extensive training on handling Carrier chiller units. Introducing a different chiller brand would require additional training, leading to higher expenses and potential delays in case of emergencies. By sourcing Carrier brand chillers to replace the existing Carrier chillers will ensure seamless integration without the potential for significant modifications that may be required for other brands. The modifications needed for other brands could lead to extended downtimes and adversely affect facility operations.

6. DETERMINATION THAT THE ORDER REPRESENTS THE BEST VALUE

A best value determination will be documented. Prior to placing the order, the Contracting

Officer will seek price reductions.

7. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED

Market research was conducted by in August 2023. This research consisted of reviews of similar previous procurements and a market survey through search engines of open market contractors and

Federal Supply Schedule contractors. Search engines utilized include Google, Bing, and GSA

Advantage catalog using the following search word: “Carrier chiller”. A review of GSA Advantage revealed the products are available via multiple MAS schedules provided by multiple small businesses. In order to gauge interest and capability, a sources sought notice (SSN) was posted on

GSA's ebuy.gsa.gov on 16 Aug 23 with a close date of 21 Aug 23 and sent to 47 vendors under

MAS SIN 333415HVAC. Three (3) responses were received, however none of the vendors provided answers to the questions nor did they state they were interested in bidding on this opportunity.

Based on the information received from the SSN, it is in the best interest of the government to forego soliciting on GSA eBuy as there was not sufficient interest to provide adequate price competition. It is therefore recommended that an open market solicitation be issued on SAM.gov in order to allow maximum competition and increase the likelihood of receiving a quote that meets the requirement owners needs within their price range.

8. STATEMENT OF ACTIONS TO OVERCOME BARRIERS TO COMPETITION

Prior to any subsequent procurement the market will be reviewed to assess whether any other qualified sources are available and are able to meet the Government’s requirements.
