MEMORANDUM TO THE FILE
Subj: JUSTIFICATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
FOR AN ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement (or portion of the requirement to be sole-sourced) is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
Purchase new weapon specific racks for our current high-density rolling shelving in the Ready-for-Issue room in order to properly store 177 additional rifles.
The weapon racks must be compatible with our current rolling shelving and allow proper storage of weapons and proper function of the rolling shelves.
III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS
BASED ON THE FOLLOWING (select all that apply):
A. ONLY ONE RESPONSIBLE SOURCE (select all that apply):
1. RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
2. EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. OTHER REASONS.

The brand name is for the compatibility of existing items and to ensure there is no duplication of costs to the Government by possibly having to replace the system.
The weapon racks must be compatible with our current rolling racks and allow proper storage of weapons and proper function of the rolling shelves. Our current rolling shelving is https://hdspacesaving.com/weapons-storage/.
The Aurora shelving when placed into the Hi-Density Spacesaving Systems rolling racks will meet the requirements of: fastened to the structure, weighing more than 500 pounds, and when locked secure and encase weapons and prevent access to nuts/bolts that fasten one container to another.
MCO 5530.14A, Marine Corps Physical Security Program Manual outlines requirements for weapon storage. Paragraph 8005.1.i(4) (page 8-27) states:
Arms racks and containers/safes weighing less than 500 pounds, including weapons, will be fastened to the structure or fastened together in groups totaling more than 500 pounds.
All racks or containers will be secured with chains equipped with low security padlocks or bolted together to prevent removal. Racks secured solely with bolts must be spot welded, peened, or otherwise secured to prevent removal. Racks secured with chains may be bolted together for stability and do not require bolt heads to be spot-welded or peened.
Chains will be heavy-duty hardened steel or welded, straight link, galvanized steel, of at least 5/16-inch thickness, or equivalent. Weapons containers, (when locked) that secure and encase weapons and prevent access to nuts/bolts that fasten one container to another, do not require the nuts/bolts to be spot-welded or peened. However, these nuts and bolts must be adequately tightened to prevent movement.
Our current Physical Security survey states: There are a total of four Hi-Density brand modular storage racks. The racks slide open on tracks embedded in the floor creating an aisle between each individual rack. When the racks are closed there are no aisles and they are secured with a standard turnkey lock.
The shelving, when complete must allow the Hi-Density Spacesaving Systems rolling racks to close without aisles and lock in order to meet the requirements of the Physical Security Manual.
C. URGENT AND COMPELLING. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
