COTI 1443.06-01, Rev 2, Feb 2012
(Rev Feb 2012)
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER $3,000 AND UP TO $150,000 (See FAR 13.106-1)
Date: ______July 27, 2021 PR Number: 40541485
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
New Solar Powered, bollard lighting will be procured for use in the park’s exterior landscape areas and along dark walkways between the park unit and the adjacent Eloy S. Inos Peace Park to the north east (along Industry Drive) to provide adequate lighting along park walkways where “hard wired” electrical lighting cannot be installed. The anticipated cost is approximately $115,000.00.
2. Sole Source Justification rationale (Check one and explain below):
__ ____ Only one responsible source.
______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
__X____ Other _____________________________________________________
Explain: The park is seeking the same bollard (make and model) as purchased last year (FY20) to keep its outdoor walkway lighting system uniform across all landscaped areas of the park.
One hundred 100 bollards were purchased (140P8220P0012), and now the park has a need for an additional 75 bollards lights that are consistent in appearance and operation. Having different lighting styles and operations requirements is not in the best interest of park operations at this phase of replacement because it will create an additional need to retrofit existing infrastructure that pose compatibility and repair/maintenance issues, which will further escalate costs.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
Market research was performed several times for similar bollard lights in past procurement actions 140P8220P0012 in Fiscal Year 2020 and 140P8218P0024 in Fiscal Year 2018 (previous purchase orders for this same item). One of the acceptable products specified (R-9811-FL) was provided by the awarded vendor. The park is seeking to buy more of the same bollard. See explanation above.

4. If this is a determination for sole source, the Contracting Officer certifies:
