About this file
This is a Brand Name Only Justification (J&A) form for a federal contract action seeking approval for other than full and open competition.
The Bureau of Indian Affairs (BIA), through its A16 Central Office - Services & Supplies, is pursuing a follow-on requirement for NIIMS Software Maintenance for OTS DWP (Office of Trust Services, Division of Water and Power) under a firm-fixed-price contract. The requirement is for software maintenance renewal of the National Irrigation Information Management System (NIIMS) v1.9.1 platform, which supports the re-platforming of NIIMS VI.9.1 production environment. This is a follow-on contract to 140A1624C0009, with an estimated government cost (IGE) to be determined. The requirement encompasses annual maintenance for multiple software components including NaturalOne Standard Edition, Test & Production, Natural for Ajax, Natural Security, NaturalADAS, and Entire Access, with base year and four option years. The contracting officer (Nancy Shah, Indian Affairs) has determined that the anticipated cost will be fair and reasonable based on the contractor's publicly available commercial pricing and comparison against competitive market information and previous contract pricing.
Market research was conducted per Department of Interior's Mandatory Cloud Use Policy and FAR Part 10, coordinating with the Small Business Administration to assess alternative solutions. Findings indicate that no alternative manufacturers or vendor products compatible with the proprietary NIIMS v1.9.1 architecture exist; only Software AG components can substitute for specific functions, but continued NIIMS support and modernization require the original vendor's maintenance. The statutory authority cited is FAR 12.201(a) for purchases over the simplified acquisition threshold under $9M. An RFQ will be posted on SAM.gov to ensure competition among authorized Indian Small Business Economic Enterprise (ISBEE) resellers, with only authorized resellers of the required brand-name solution eligible to submit quotations. Prior to exercising each option year, the Government will conduct market research to determine whether equivalent software maintenance and support is available.

Text11: This justification seeks approval to procure Software AG’s software maintenance and support services as a Brand Name Only requirement. The required products consist of Software AG Development and Runtime components essential to the continued operation of the National Irrigation Information Management System (NIIMS). These products include NaturalONE Standard Edition, Natural for Ajax, Natural Security, Natural, ADABAS, and Entire Access—each of which is proprietary to Software AG and integral to both the application environment and the data structures used within NIIMS.The NIIMS platform relies on Software AG’s proprietary development framework, runtime engines, and database technologies. The Government does not possess technical data, source code, or interface specifications necessary to replace or modify these components with non‑Software AG products. Market research confirms that no alternative vendor offers compatible maintenance or support services for these products, and that substituting non‑compatible tools would result in system failure, data access interruptions, and the inability to maintain mission‑critical daily operations. Although modernization efforts for a new NIIMS application are currently underway, the Bureau of Indian Affairs (BIA) requires continued maintenance, updates, and customer support for the existing NIIMS V1.9.1 system for a minimum of two years. During this period, approximately 50 end users must retain uninterrupted access for operations, reporting, regulatory compliance, and irrigation program management. Continued software maintenance is also required to support data integrity, security patching, and issue resolution throughout the transition period. Furthermore, data migration and final system decommissioning will not occur until approximately one year after the new system enters production. Without continued Software AG maintenance coverage, the Government would face significant operational risk, including system outages, unsupported failures, loss of security updates, and delays to the modernization program. Given the proprietary nature of the Software AG product suite and the absence of any technically viable alternatives, Software AG is the only responsible source capable of meeting the Government’s minimum needs for the NIIMS platform during the transition period.
Text12: A notice will be publicized on SAM.gov in accordance with FAR Subpart 5.2 for this ISBEE requirement as a Brand Name or Equal acquisition.
Text13: The anticipated price is expected to be fair and reasonable based on the contractor’s provision of commercial pricing that is publicly available, as well as the Government’s comparison of the proposed pricing against both competitive market information and the pricing under the previous contract.
Text14: Market research was conducted in accordance with the Department of the Interior’s Mandatory Cloud Use Policy and the procedures outlined in FAR Part 10. As part of this effort, the Bureau of Indian Affairs (BIA) evaluated available commercial and cloud‑based solutions capable of supporting or replacing the legacy National Irrigation Information Management System (NIIMS) V1.9.1 platform. Activities included coordination with the Small Business Administration, review of modernized SaaS alternatives, and assessment of vendors capable of delivering long‑term sustainment or modernization support. The results of the market research indicate that no alternative manufacturer or vendor offers products compatible with the proprietary NIIMS V1.9.1 software architecture. The legacy system relies on Software AG components that cannot be substituted or supported by other manufacturers. Communications with Steph Wilson of Software AG during the renewal‑quote process further confirmed that Software AG is the only source capable of providing maintenance and support for the existing NIIMS environment. Although development of the modernized NIIMS application is ongoing, continued maintenance and support for NIIMS V1.9.1 is required to sustain operations for approximately 50 users. This support is necessary to ensure system availability, security updates, troubleshooting, and data integrity throughout the transition period and until the legacy system can be fully decommissioned.
