4. Statutory Authority Permitting Other Than Full and Open Competition
41 U.S.C. 1901(e)(2), a sole source (including brand-name) acquisition under the authority of Simplified Procedures for Certain Commercial Items, as implemented by Federal Acquisition Regulation FAR Subpart 13.501(a).
5. Rationale Justifying Use of Cited Statutory Authority
An uninterruptible power supply (UPS) is crucial to ensure mission-critical military operations. UPS systems deliver real-time backup power when a regular grid power source fails. To ensure technical uniformity across the Navy Surface fleet, these UPS system items being purchased will ensure compatibility/commonality, technical requirements compliance, control system performance, lifecycle management, logistics supportability and reduced total ownership cost over the lifecycle of the project. Per Technical Warrant Holder NAVSEA 05Z, US Navy ships are now required to use common commercially off the shelf UPS systems that can also meet US Navy qualifications, but shall only use standard configurations. LPD and LSD class ships already are designed to meet this requirement and use the standard configurations as stated in the commonality MIL-DTL-24765B specification sections 3.2.2a and 3.2.2b allowing bulkhead UPS systems to be used saving space onboard ships. LPD-17 and LSD-49 class hulls are following the commonality standard using bulkhead UPS units when “zonal” UPS is employed in the ship design. In this “zonal” UPS design, UPSs are consolidated in an area and used to feed power to electrical equipment within that same designated shipboard fire zone. This procurement requirement will replace existing bulkhead mounted UPS systems.
UPS system suppliers must have a product line that exists for bulkhead mounting using 450 or 480VAC three-phase input and single phase AC 115 / 120 VAC outputs. UPS OEM’s such as were thoroughly vetted, but none possessed bulkhead mounted with the required 450/480VAC three phase AC input, 30-minute battery runtime at 50% load and 115 / 120 VAC single phase 60Hz output requirements. Leonardo DRS Pivotal Power is the only company that manufactures the bulkhead mount 480VAC three-phase input power
