Brand Name Justification and Approval
1. Agency and Contracting Activity:
Office of Secretary of Defense, Defense Microelectronics Activity (DMEA).
2. Nature/Description of Action:
New firm fixed price contract to renew and update DMEA’s existing Vivado Software licenses.
3. Description of Supplies/Services:
The Contractor shall renew, update, and upgrade DMEA’s suite of Vivado Software licenses.
The anticipated dollar value of this procurement is _.
4. Authority Cited:
FAR 16.505(a)(4)(ii). Requirements for use of items peculiar to one manufacture shall be justified and approved using the format(s) and requirements from FAR 16.505(b)(2)(ii) A-C, modified to show the brand-name justification.
5. Reason for Authority Cited:
The Vivado simulation environment is a design and verification tool used by DMEA to program Xilinx FPGAs. DMEA uses Xilinx FPGAs on numerous products across multiple Organic Engineering programs. The Vivado Software owned by DMEA provides Engineers the optimum way to interface and program multiple variants of Xilinx FPGAs. Switching to another FPGA software interface would add extra cost, impact project schedules, and may not provide an adequate interface to these electronic components. Thus, procuring either directly from AMD/Xilinx, the proprietary owner, or one of its authorized distributors is the only viable way of fulfilling this requirement.
6. Efforts to Obtain Competition:
AMD/Xilinx is the proprietary owner of the Vivado software and there are eight authorized distributors. Two of the authorized distributors are WOSB/HUBZone certified; however, the acquisition history indicates a HUBZone set-aside would not yield any responsible offers. Thus, the request for quote will be posted on SAM.gov for full and open competition.
7. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This determination is based upon the Independent Government Estimate (IGE) and previous purchases.

Vivado is a software tool made by AMD/Xilinx and is used to program AMD/Xilinx FPGAs.
Market research consisted of a review of the authorized distributors list on the AMD.com website. The search identified TD Synnex, Spirit Electronics, Port Electronics, Newark, Mouser Electronics, Ingram Micro, Digi-key, and Avnet as authorized distributors. Additionally, the business size of each authorized distributor was reviewed. Digi-key is a large business, while Spirit Electronics and Port Electronics are both WOSB/HUBZone certified. The other authorized distributors business size is unknown.
