About this file

This document is a Brand-Name Justification and Approval (J&A) from the Department of the Navy's Naval Surface Warfare Center, Philadelphia Division. The document justifies a sole-source, brand-name procurement of Siemens Programmable Logic Controller (PLC) hardware and software components for the Machine Control System (MCS). The procurement includes 20+ different Siemens components such as SIMATIC units, communication processors, memory cards, and software licenses, totaling approximately 200 individual items.

The Navy determined Siemens is the only responsible source due to unique technical requirements, specifically the need for compatibility with existing shipboard hardware and software for New Construction, Modernization, and Technical Refresh programs. A Sources Sought Notice was posted from September 2-17, 2025, receiving 4 responses, with 2 companies deemed technically capable. A subsequent synopsis on November 13, 2025, generated 3 responses. The procurement is justified under 41 U.S.C. 1901(e)(2) for simplified procedures for commercial products, with the estimated delivery timeframe of 8 weeks from the award date. The contracting officer has determined the anticipated costs to be fair and reasonable.

J&A No. 0233-26-084-00

4. Statutory Authority Permitting Other Than Full and Open Competition.

41 U.S.C. 1901(e)(2), sole source (including brand-name) acquisition under the authority of

Simplified Procedures for Certain Commercial Products and Commercial Services.

5. Rationale Justifying Use of Cited Statutory Authority.

Siemens is the only responsible source, and no other supplier will satisfy agency requirements based on the following unique characteristics that are essential to the Government.

The specified equipment and software have characteristics and specifications that are unique and cannot be identified in any similar equipment offered by competitors. contract 4 GFE hardware transitioned from VME to PLC based technology for the Data Interface Unit (DIU) consoles and this procurement is required at NSWCPD for development and validation to deploy a fully validated MCS system shipboard for New Construction, Modernization, and

Technical Refresh programs. MCS hardware and software must be procured on a brand name basis from an authorized reseller of the original equipment manufacturer (OEM), Siemens.

New Construction, Modernization, and Technical Refresh programs are receiving

Siemens DIU consoles shipboard. The components procured under this contract will be utilized in the lab to develop and test MCS SW that is compatible with shipboard hardware.

Siemens Industrial Control and Communication components, outlined above, are required to support MCS as they maintain a culmination of characteristics and specifications that allow MCS to operate on existing infrastructure, run MCS software, and provide an improved

MCS performance and enhanced MCS cybersecurity posture. For example, MCS software is written using variations of IEC 61131-3 standard Programmable Logic Controller (PLC) languages in Siemens TIA Portal, and compiles into machine code that can only run on Siemens brand PLCs. Additionally, the MCS network infrastructure configuration uses various communication and redundancy protocols including Profibus, Profinet, Profinet-IRT, Media

Redundancy Protocol (MRP), and Standby-Connection protocol. These protocols allow MCS to communicate with the specific HME equipment on Siemens brand Industrial Control components are uniquely designed to support this aggregation of protocols. Finally, this procurement requires hardware and software that can natively operate with other MCS infrastructure components that are not being replaced as part of this effort. Based on market research, the culmination of these specifications cannot be identified in any other industrial control and communication hardware and software therefore driving the brand name purchase of these Siemens components.

Use of non-Siemens brand components in the lab will lead to incompatible MCS SW that would not operate with shipboard Siemens Hardware. MCS system would not be operational and HME equipment would not be able to communicate over the network. Loss of MCS would disrupt the ability for Ships Force operators to monitor and control HME equipment and perform mission critical system tasks. Such a situation would prevent class ships from being deemed fit to sail due to unacceptable risks to mission and crew and would negatively impact

War-Time Readiness. Thus, the Siemens brand-name components are essential to the

Government’s requirements, thereby precluding consideration of a product manufactured by another company.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A Sources Sought Notice (SSN) was posted to SAM.gov from September 2, 2025 to September

17, 2025, and 4 responses were received. Responses were received from

. Two of the responding companies were determined to be Technically Capable of supplying the required materials.

A synopsis of the requirement was posted to SAMs.gov on November 13, 2025. 3 responses were received.

Through the SSN process, a synopsis posting, and market research, it has been determined that there are at least two (2) potential sources to supply the required materials, and that proceeding as a Brand Name procurement would yield sufficient competition for supplying the required materials.

7. Determination of Fair and Reasonable Costs.

The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this Justification will be fair and reasonable.

8. Actions to Remove Barriers to Competition.

For the reasons set forth in Paragraph 5, NSWCPD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
