About this file
This document is a FAR Part 13 Justification and Approval for Other than Full and Open Competition for a Foreign Military Sales (FMS) procurement. The U.S. Army Contracting Command-Aberdeen Proving Ground seeks to purchase thirty (30) ViaSat KG-250X In Line Network Encryptors (Part Number 1101000) for the Slovak Republic, with a brand-name sole source justification. The procurement is valued under $750,000 and will use FMS non-repayable funds.
The justification highlights that the KG-250X is a Type 1 NSA-certified encryptor for secure NATO communications, and alternative brands would require 12-36 months of testing and validation. Market research conducted from July 31 to August 5, 2024, identified only ViaSat, Inc. and Unmanned Systems Technology as potential sources. The anticipated contract award is expected no later than June 30, 2025, under a 100% Small Business Set-Aside with NAICS Code 334220, and will be evaluated using a Lowest Priced Technically Acceptable (LPTA) approach.

FAR Part 13 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: Army Contracting Command - Aberdeen Proving Ground ACC-APG 6515 Integrity Court, Bldg. 4310 Aberdeen Proving Ground, MD 21005
2. Description of Action: This proposed action is for the award of a Firm-Fixed-Price (FFP) “Brand Name” supply contract to purchase Commercial-Off-The-Shelf (COTS) hardware of KG-250X In Line Network Encryptors, Part Number 1101000. This is a Foreign Military Sales (FMS) Case for Slovak Republic using FMS funds (non-repayable).
3. Description of Supplies/Services: The hardware to be procured is as follows: Qty: thirty (30) KG- 250X In Line Network Encryptor - Part Number 1101000
4. Authority Cited: 41 U.S.C.1901as implemented by FAR13.501(a)(2)(i), For a proposed contract exceeding the simplified acquisition threshold, but not exceeding $750,000, the contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief will serve as approval, unless a higher approval level is established in accordance with agency procedures.
5. Reason for Authority Cited:
CECOM-SAMD requires the ViaSat brand KG-250X P/N 1101000, in support of the Slovak Republic.
The KG-250X will allow mission requirements to be met as it relates to standing up a Public Affairs office for the Slovak Republic. The KG-250X is a Type 1 NSA-certified encryptor used for secure communications with NATO partners. Other brands will need to be tested and evaluated for NATO certifications and that can take 12-36 months.
If ViaSat Encryptors are not procured and a different P/N is qualified, the government risks significant operational setbacks. Qualifying an alternative system would lead to delays in deployment, additional costs in testing and validation, and potential compatibility issues. These delays and costs would not only strain the budget but also compromise CECOM-SAMD mission readiness and effectiveness in critical situations, potentially costing $500,000.00 and extending project timelines by 15 months.
There are no form and fit requirements. The U.S. Government does not possess the technical data package (detailed designs) for these items.
6. Publicizing Contract Actions: The requirement is in accordance with FAR 13.501(a)(ii) and is a brand name restriction over $30K. It will be redacted and posted with the solicitation.
7. Efforts to Obtain Competition: In accordance with FAR 12.603, Streamlined solicitation for commercial products or commercial services, a combined synopsis/solicitation will be posted
