JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (BRAND NAME)
U.S. GENERAL SERVICES ADMINISTRATION
J. J. PICKLE FEDERAL OFFICE BUILDING, ELEVATOR UPGRADE, AUSTIN, TX
SOLICITATION NUMBER: 47PH0923R0022
MAY 4, 2023
I. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY
Agency Identity: Region 7 Public Buildings Service (PBS) of the U.S. General Services Administration (GSA)
Contracting Activity: Acquisition Management Division, Non-Prospectus Projects Branch (7PQC)
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED
This document sets forth the justification and approval of the use of one of the exceptions to full and open competition allowed under the Competition in Contracting Act (CICA) of 1984. This contract action is for the purchase of a particular communication device as described in Section III below, to upgrade one (4) Hydraulic Passenger Elevator located at the Austin Federal Office Building, 300 East 8th Street, Austin, TX 87801
III. DESCRIPTION OF SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
The communication device to be acquired for this elevator modernization project is the MAD
MosaicONE VMS (“MAD”). All work performed under this contract shall meet or exceed the current
ASME-A17.1 Elevator Code and the Uniform Federal Accessibility Standards.
The estimated value of this acquisition is: $
IV. IDENTIFICATION OF AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION
The statutory authority permitting other than full and open competition is 41 USC 3304(a)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled “Only One
Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”.
V. DEMONSTRATION THAT THE NATURE OF ACQUISITION REQUIRES USE OF THE AUTHORITY CITED
The MAD communication device is essential to GSA’s requirements and is the only approved product that will satisfy the agency’s needs. In the past, both Rath and MAD elevator products were moving through the GSA Information Technology (IT) scanning process, which would allow these products to be connected to the GSA network for use in the newly renovated and newly constructed elevators designed under the 2019 ASME-A17.1 Elevator Code. Currently, Rath and MAD are the only non-proprietary products on the market that had completed GSA’s required approval process and had been accepted for use. However, Rath has withdrawn from the process and is no longer a viable option for installation.
Therefore, the MAD communication device is currently the only acceptable device for use with GSA’s network; and the only available source that can meet the Government’s requirement due to its unique capability (FAR Subpart 6-302-1(b)(1)(i)).
VI. DESCRIPTION OF EFFORTS MADE TO IDENTIFY ADDITIONAL SOURCES
Since this is a justification for a brand name/sole source procurement in accordance with FAR Subpart
6.302-1, other sources will not be solicited. As stated in Section V above, GSA has utilized other communication devices (Rath) in the past; however, Rath products are no longer a viable option.
