BRAND NAME JUSTIFICATION

FOR AN ORDER/BPA EXCEEDING MICRO-PURCHASE THRESHOLD

AND UP TO THE SIMPLIFIED ACQUISITION THRESHOLD

(AUTHORITY: FAR 8.405-6)

PR# NFFKAE402202309

This acquisition is conducted under the authority of the Multiple Award Schedule Program.

1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants Office (AGO), NOAA/NMFS/OLE/AKD Seward Field Office

2. Description of supplies or services required to meet agency needs (including the estimated value).

• Provide three Suzuki 300DP 30” shaft, black engines. One SMD 9” Kit. Labor associated with installing new equipment.

• Complete necessary wiring to ensure the vessels ability to charge engine and house batteries during underway operation. Also ensuring that when shore power is connected, all batteries will be charging.

3. Identification of the limited source(s) to be solicited. N/A

4. Authority and supporting rationale. The contracting officer has determined the following circumstance justifies limiting the source under FAR 8.405-6 and as supported below:

Item(s) peculiar to one manufacturer (including brand name) - FAR 8.405-6(b) – OLE is specifically requesting Suzuki Outboards. Seward Heavy Industrial Power (SHIP) is the only Suzuki Outboard maintenance company within 129 miles that is certified to work on Suzuki engines (Peninsula Power Sports is 129 miles from Seward and is the nearest, which would require a towing contract over $1,200 each way). In the City of Seward, no other Marine Maintenance facilities have certified Outboard technicians for any other brand of engine. Patrol Vessel Cape Elizabeth is assigned to the Seward field office. If another brand were to be selected, the vessel would have to be transported to Kodiak or Homer to have maintenance and recalls completed by a certified technician. Homer and Kodiak both have certified Yamaha technicians, which is why we have patrol boats in those locations with Yamaha outboards.

5. Market Research

OLE contacted Kodiak Power Sports, Peninsula Power Sports and Seward Heavy Industrial Power for cost comparisons between Repowering with twin Yamaha 425’s or maintaining the triple Suzuki Outboards. Based on the cost to cut the swim deck off and fabricate a new one, and not having access to Certified Yamaha technicians in the Seward AOR, we determined maintaining the triple Suzuki setup would be the most efficient option. The vessel already has the wiring, fuel pick-ups, battery setup and harnesses for three Suzuki Outboards, which reduced the total cost of the project by allowing OLE to only have to purchase the engines and one upgraded display. Based on current operations conducted, the triple Suzuki setup also has a fuel efficiency 15% greater than the twin Yamaha 425’s.
