About this file
This document is a Brand Name Justification for a Conviron Model PGR15 Plant Growth Chamber for the USDA, Agricultural Research Service, Southeast Area Office. The USDA requires this specific Conviron brand chamber to ensure high precision and replicability of experiments, as they currently own three identical chambers. The purchase will be a firm-fixed price order under a small business set-aside. Quotes are due by April 17, 2024, and the chamber must be delivered FOB Destination within 90 days of award. The Contracting Officer expects adequate price competition from multiple vendors that sell Conviron products. This justification will be posted with the solicitation on SAM.gov.

Southeast Area Office
Conviron Model PGR15 Growth Chamber
ITEMS PECULIAR TO ONE MANUFACTURER (Brand Name Justification)
The USDA, Agricultural Research Service, Southeast Area Office requires a Controlled Environments, Inc. (aka Conviron) model PGR 15 growth chamber. This documentation is being prepared to record the basis for restricting consideration to an item peculiar to one manufacturer.
1. Contracting Activity.
USDA, Agricultural Research Service, Administrative and Financial Management, Southeast Area Office. Contract Specialist, Amanda Somerville, Amanda.Somerville@usda.gov.
2. Nature/Description of Action.
Open Market, Firm Fixed Price purchase order. One (1) Controlled Environments, Inc. (aka Conviron) model PGR 15 growth chamber (chamber). The chamber must be a Conviron brand name only. Fiscal Year 2024 funds will be used.
3. Description of Supply/Services.
The chamber is used by the USDA, Agricultural Research Service, Southeast Area Office, Crop Production Systems Research Unit (CPSR) located in Stoneville, MS for its mission critical experiments. One (1) Controlled Environments, Inc. (aka Conviron) model PGR 15 growth chamber. FOB Destination delivery is anticipated to be ninety (90) days after award.
4. Statutory Authority.
Pursuant to Federal Acquisition Regulation (FAR) 11.105 and 6.302, for purchases of items peculiar to one manufacturer, Agency requirements shall not be written so as to require a particular brand-name, product, or a feature of a product, peculiar to one manufacturer, unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs; the authority to contract without providing for full and open competition is supported by the required justifications and approvals in accordance with FAR 6.302-1, or the basis for not providing for maximum practicable competition is documented in the file (see 13.106-1(b)) or justified (see 13.501) when the acquisition is awarded using simplified acquisition procedures; and the documentation or justification is posted for acquisitions over $25,000 (see 5.102(a)(6)).
5. Justification Rational.
The chamber must be a Conviron brand name only. The CPSR currently owns three (3) of the same model chambers. It is essential for high precision in replicating experiments to ensure any new chambers are identical to the current chambers; particularly the optical characteristics of the material constructing the interior wall of the chamber. Use of different growth chambers will not provide confidence in the validity and/or reliability of the results since the experiments cannot be properly replicated.
6. Best Value Determination.
The chamber has been purchased before and has established catalog pricing. As a result, the Contracting Officer can anticipate determining the price fair and reasonable. Additionally, the chamber is sold by more than one vendor, so more than one quote can be expected for adequate price competition.
7. Market Research.
Recent market research shows Conviron products are available from multiple vendors on the open market.
8. Additional Support.
None.
9. Actions Taken to Remove Barriers from Competition.
This justification will be posted with the Request for Quotes to www.SAM.gov (FAR 13.501(a)(1)(iv)).
