FEDERAL BUREAU OF INVESTIGATION

FINANCE DIVISION I PROCUREMENT SECTION

JUSTIFICATION AND ApPROVAL (J&A) FOR OTHER THAN FUll AND

OPEN COMPETITION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCO~I?~_NCEWITH 41 U.S.c. 3304 (A)(XH

Requisition Number: DJF-22-1800-0002139

Date: 2/1/2022

Estimated Contract Dollar Value: $28,070.00

1. Identification of the agency and contracting activity.

The U.S. Department of Justice, Federal Bureau of Investigation (FBI), National Acquisitions Program Unit (NAPU), has prepared this justification for other than full and open competition for JTK-17B Jensen BackPack Tool Kit on behalf of the TIA Operations and Development Unit, Operational Technology Division.

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.

The JTK-17B.Jensen Back Pack Tool Kit is a combination of tools used by Technically Trained Agents (nA) in the field to install or create concealments and troubleshoot electronic issues.

This will need to be sole source due to TODU previously purchasing this exact type of backpack for previous TIAs in the field. This backpack has the exact tools that other companies do not include in one backpack. The kits include multiple wrenches, gauges, cutters, and specifics blades that work with the techniques that are taught in class and the same tools TIAs certify with.

3. A description of the supplies or services required to meet the agency's needs.

The requirement is to provide a variety of tools to assist TIAs in technical installments for a variety of cases in the Field at an estimated total cost of $28,070.00 to be delivered by 5/1/2022. The office was made aware of the requirement in January of 2022. This will allow the TIAs to accomplish its mission of providing direct and indirect support to TTAs across the

FBI.

4. The statutory authority permitting other than full and open competition.

The Statutory authority permitting other than full and open competition is 41 U.S.c. 3304 (a) (1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements."

5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

Jensen is uniquely qualified to provide these services to the FBI-based upon the following: They have the exact tools in one kit that no other brand can provide. The Jensen brand contains multiple tools that no other kits can provide with the brand names that are in the kits. Other kits do not provide the exact brand name tools included in the kits for a reasonable price of $625 each and can ship that quantity in a suitable timeframe for our training classes by 5/1/2022.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

The CO recommended to post via betaSAM.gov announcement due to the vendor not quoting a non-GSA scheduled item. There are no additional requirements.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The costs are based on the market price and the availability of the tools. TODU has purchased these kits in the past around 600-630 each. The Specialized Products Co. even offers a 1% discount which is reasonable and fair to the government.

8. A description of the market research conducted and the results.

The market research was conducted through previous requisitions that bought the Jensen Tool Kits. Additional internet searches were completed to obtain quotes and vendors who carried the Jensen Tool Kits.

9. Any other facts supporting the use of other than full and open competition.

The supplied cannot be modified due to the purchase of the exact same kits last Fiscal Years.

These kits have the exact tools the TIAs needs for cases and installments. If we change the contents of the kits we cannot give them out to the TIAs. In addition, we also train with these exact type ohools in the classes the TIAs attend.
