Re: Request for Proposal: Solicitation No. AG 24-0016: Outside Counsel Services –
Consumer Fraud and Related Civil Actions (Contingency Fee Only)
Dear Ms. Palmer and Ms. Flanagan:
My law firm, Keller Rohrback L.L.P., is pleased to submit our response to the RFP referenced above. I am a member of the firm here in the Phoenix office and am authorized by the firm to negotiate and contractually obligate the firm to a contract with the State of Arizona. If selected to perform the “as needed, if needed” work specified in the RFP, Keller Rohrback explicitly accepts the requirements of the RFP.
Keller Rohrback is a national law firm founded in 1919, with our largest office in Seattle, Washington, and other offices in Arizona (Phoenix), California, Colorado, New York, Oregon, and Montana. Keller Rohrback has a well-established track record of pursuing high-stakes claims against Fortune 500 companies. We excel in our cases because we are prepared and persuasive.
Keller Rohrback has extensive experience in pursuing claims against large corporations for consumer protection and negligence under state statutory and common law theories and years of experience litigating cases on behalf of governmental entities. When we are hired, Keller
Rohrback commits to our clients to do everything needed to thoroughly litigate the case, including hiring world-class experts and taking cases to trial.
With respect to this proposal, Keller Rohrback has extensive experience representing governmental entities in complex cases. Keller Rohrback currently represents the States of
Maryland and Delaware, as well as the City of Seattle, in litigation against Monsanto over environmental contamination from PCBs. Keller Rohrback’s commitment to high quality work and seeing cases through has created outstanding results: in late 2022, we finalized a settlement on the eve of trial on behalf of the State of Oregon in its case against Monsanto for $698 million, the largest environmental recovery in that state’s history. Further, the Firm represents the State of
Alaska in consumer protection litigation against JUUL Labs regarding youth vaping and recently helped resolve Alaska’s claims against Altria for its contributions to youth vaping.
Our work has garnered the praise of state and federal courts throughout the country, and we have recovered more than $78 billion for our public and private clients. We have helped lead many nationally prominent public impact cases, including the Volkswagen diesel emissions fraud litigation, serving as Co-Lead Counsel in the JUUL MDL and serving on the plaintiffs’ executive committee for the Opioid MDL, the largest public health MDL in history. Keller Rohrback is also co-lead counsel in the Facebook / Cambridge Analytica MDL, which recently settled for
$725 million dollars and will provide benefits to millions of consumers.
As described further in Attachment I, the Firm’s experience makes us an ideal partner for this type of representation. As a result of our experience working with government clients, we understand the high degree of legal expertise and professionalism that is at all times required and the justifiably higher standard that courts and the public expect from government litigants. The
Firm has both the financial and staff resources to handle lengthy and costly litigation, including document-intensive matters. Based on our past experience in complex litigation, the Firm is acutely aware that litigation of the type covered by this RFP may require the Firm to house and review millions of documents, advance costs that can be substantial, and invest millions of dollars in attorney time. The Firm is sufficiently staffed and prepared to handle all aspects of any investigation or litigation for the State of Arizona—from filing, to discovery, trial, and appeal.
We are pleased to submit this response and are grateful for the opportunity to be considered to represent Arizona.
Best regards, Adam L. Rosenberg
