STATEMENT OF WORK
INVESTIGATIVE SERVICES
Part A – General
A.1 Goal of Investigative Services Contracts
The goal of investigative services contracts is to provide assistance to Bonneville Power Administration (BPA) managers who in order to carry out the duties of their positions need to obtain timely and reliable information regarding a wide range of workplace issues, including but not limited to violations of law, BPA policy or other conduct standards applicable to BPA employees.
A.2 Background
BPA managers have authority to inquire into and to take administrative actions regarding the conduct of the employees in their workplace. BPA provides managers advice and assistance in that role through its Employee Relations and Office of General Counsel organizations. When managers wish to obtain competent investigative services for the gathering of information rather than to undertake the investigative process themselves, they can authorize Employee Relations or the Office of General Counsel to conduct an investigation.
A.3 Location of Work
In most cases, the work required by investigative services contracts will be carried out at BPA facilities somewhere in the BPA service area in the Pacific Northwest. Such facilities are located at BPA’s headquarters in Portland Oregon and Vancouver Washington and also in various field locations throughout the service area. Individuals working under an investigative services contract (contractor) will be required to provide their own transportation to such facilities unless otherwise agreed to before start of work. Reimbursement for travel and/or mileage will be per the Federal Travel Regulations.
A.4 BPA-Furnished Property and Services
BPA’s Employee Relations or Office of General Counsel organizations will provide the contractor with detailed oral and/or written instructions that may include (1) description of the purpose of the investigation, (2) sufficient background information to allow the investigator to understand the purpose of the investigation, (3) relevant organizational background, (4) names, positions, location, contact information and summary of potential relevance of individuals to be interviewed, (5) proposed schedule for interviews, (6) location and description of facilities available for the conduct of the interviews and (7) means of communication between the investigator and the BPA manager, Employee Relations and/or Office of General Counsel organizations. In some instances, BPA or the contractor may also provide court-reporting services for the documentation of interviews.
A.5 Contractor-Provided Property, Equipment and Services
Other than those mentioned under paragraph A.4, a contractor working under an investigative services contract will furnish all property, equipment and services required to satisfy the instructions for the investigation and to produce the work product specified in those instructions.
A.6 Investigator Qualifications
Prior to working under an investigative services contract, contractors will have submitted to BPA their qualifications: education, training and/or experience as well as their ability to drive a motor vehicle legally and ownership of liability insurance coverage suitable for such work.
Part B – Technical Approach/Tasks
B.1 General Requirements
A contractor is required to conduct an investigation following the written and/or oral instructions from BPA’s Employee Relations and/or Office of General Counsel organizations. A contractor shall produce in a timely fashion the investigative work product specified by those instructions that will assist a BPA manager to make an informed, fact-based decision regarding the workplace issues under investigation.
B.2 Methods To Be Used
A contractor must be able to (1) meet with BPA managers and/or personnel from BPA’s Employee Relations and/or Office of General Counsel organization at the beginning of the contract as a preliminary or supplement to written instructions, (2) as required by the written or oral instructions, conduct face-to-face and/or telephone interviews sufficient to obtain all available information relevant to the workplace issues under investigation, (3) document such interviews in the manner required by the written or oral instructions, (4) identify, and obtain any documents relevant to the workplace issues under investigation, (5) provide written and/or oral reports regarding the investigation results in the manner specified in the instructions. Documentation of interviews may be in the form of investigator notes without affirmation by witnesses, investigator-drafted summaries of interviews reviewed and affirmed by witnesses, or court-reporter transcripts of interviews. Unless specifically provided by BPA under the terms of the investigative services contract, a contractor shall be required to provide whatever devices or services may be necessary to accomplish such documentation.
B.3 Specific Requirements and Deliverables
Investigations must be initiated and completed, including provision of investigation reports, within the time period specified in the written or oral instructions. Deliverables required by the contract may include (1) witness statements, documented in the manner required by the instructions, (2) documents obtained during the investigation with adequate reference (e.g., tabbing, exhibit designation, etc.) and (3) written or oral investigative report. Subject to the specific instructions for the investigation, written investigative reports required by the contract may include (1) title page, (2) investigator’s biographical data, (3) statement of the workplace issue under investigation, (4) summary of the investigative process, (5) summary of the information obtained from witnesses, including investigator’s explanation for findings of disputed facts, (6) advisory analysis of applicable law and/or BPA policy to the information obtained and facts found, (7) documents provided as part of the instructions for the investigation, (8) witness statements documented in the form required by the instructions, and (9) documents obtained during the investigation with adequate reference (e.g., tabbing, exhibit designation, etc.) for understanding.
Part C – Quality Assurance
BPA reserves the right to review the completeness and quality of any performance required by the investigative services contract, including deliverables specified in the written and/or oral instructions, and to notify the contractor of any additions or improvements that will be necessary before payment.
