About this file

This document contains a determination and finding to consolidate two federal construction contract requirements into a single award. The Bureau of Reclamation seeks to replace station service switchgear, relays, switchboards, power generators and other equipment at the Flaming Gorge and Fontenelle Power Plants in Utah and Wyoming. Market research found sufficient small businesses capable of meeting requirements at both locations through a consolidated contract. The contracting officer determined this approach would streamline the procurement process and improve consistency across plant equipment, while maintaining opportunities for small businesses. The solicitation for a competitively awarded firm fixed price construction contract is forthcoming.

Text version

Based on the market research data, there are enough prospective small businesses which can provide the required work in both locations.

Any alternative contracting approaches and rationale for rejection:

The Contracting Officer considered the issuance of individual contracts for each power plant;

however, given the remoteness of each work site and similar scope of work, awarding individual construction contracts is not efficient and will increase the Government’s overall costs to procure and administer each project.

Impacts associated with contracting with small business concerns:

Based on the market research, consolidating the requirement will not result in negative impacts to the acquisition or the small business community. Market research identified at least nine small businesses that can perform the construction work at the required locations. Previous projects similar in magnitude and complexity have yielded adequate competition when set-aside for small business.

Considerations, Facts, and Reasoning Supporting the Determination:

The Contracting Officer considered the following in making the determination to consolidate the requirements into single award contract:

The cope of the proposed work and the need to have requirements fulfilled quickly and efficiently.

Past contract types utilized to fulfill similar requirements.

Recent contract history for similar requirements.

The requirement to set-aside contracts for small businesses.

The Contracting Officer found the following facts in making the determination to consolidate the requirements into a single award contract:

Market research demonstrated there enough small businesses who can provide the required services for both locations in one contract.

Individual construction contracts depending on the size, scope and complexity can have long acquisition timelines and pose impacts to Reclamation’s ability to fulfill its mission requirements to generate power.

This requirement covers two power plants within a close geographical location where having a single vendor perform the work at both locations will improve the consistency of the equipment installed at each power plant as well as lowering mobilization costs.

Summary:

The ability to use a single construction contract creates a streamlined and efficient approach to procurement and improves the consistency across both plants. Market research has demonstrated there are enough small businesses which can fulfill the requirements of the Government. Therefore, the contracting officer has determined that consolidation under a single contract, total small businesses is in the best interest of the Government.
