About this file
This is a Domestic Workforce Utilization Certification form for the Pennsylvania Department of General Services (or other purchasing agency) related to a services Request for Proposal (RFP) for the District 5-0 Lopp Sensor Contract with the Pennsylvania Department of Transportation (PennDOT). The certification applies to contractors bidding on the Invitation for Bid (IFB) to furnish and install loop detector sensors across all six counties within PennDOT Engineering District 5-0. The contract evaluation will incorporate domestic workforce utilization as a scoring criterion, with offerors required to complete and sign the certification to receive consideration on this factor.
The certification requires offerors to declare the percentage of direct labor that will be performed either exclusively within the United States or within countries that are parties to the World Trade Organization Government Procurement Agreement. Contractors electing to perform any portion of direct labor outside the United States and outside WTO-GPA member countries will receive correspondingly reduced scores. The document provides a comprehensive list of eligible WTO-GPA member countries and requires contractors to identify any work performed outside approved geographic boundaries and the specific countries where such work will occur. Failure to complete and sign the certification results in forfeiture of scoring consideration for this criterion. Any misstatement on the certification is treated as fraudulent concealment under Pennsylvania law and is subject to penalties under Section 4904 of the Pennsylvania Crimes Code.

DOMESTIC WORKFORCE UTILIZATION CERTIFICATION
To the extent permitted by the laws and treaties of the United States, each proposal will be scored for its commitment to use the domestic workforce in the fulfillment of the contract. Maximum consideration will be given to those offerors who will perform the contracted direct labor exclusively within the geographical boundaries of the United States or within the geographical boundaries of a country that is a party to the World Trade Organization Government Procurement Agreement. Those who propose to perform a portion of the direct labor outside of the United States and not within the geographical boundaries of a party to the World Trade Organization Government Procurement Agreement will receive a correspondingly smaller score for this criterion. In order to be eligible for any consideration for this criterion, offerors must complete and sign the following certification.
