Memorandum for Record – Limiting Competition at or below the Simplified Acquisition Threshold

2. Description of Action: Purchase of Tool Cat UW56

3. Description of Services or Supplies: USAHEC needs to replace a utility work vehicle that is vital to building maintenance and operations on its extensive campus.

This includes work on all buildings, trail exhibits, parking lot, and all walking surfaces.

USAHEC has many unique features and tasks such as maintaining the Army Heritage Trail- both the walking path and exhibits- and has extensive areas not covered by the DPW snow removal contract.

The current vehicle was capable of having a blade, bucket, and pallet forks installed, however due to the vehicle being produced in 2009, replacement parts are no longer available to fix the vehicles attachment arm rendering the cart inoperable for its mission.

The Tool Cat that fits the needs is the UW56, Model M1225, Side by Side with standard equipment plus:

• Deluxe road package M1225-P01-C01,

• Attachment control M1225-R08-C02,

• Engine block heater M1225-A01-C02,

• Heavy Duty Battery M1225-R07-C02,

• High Flow Package M1255-R01-C02,

• Power Bob-Tach M1225-R14-C03,

• Traction Control M1225-R16-C02,

• 56” Cargo Box with a 2000Lb load capacity,

• One-Year Warranty

• PLUS, a 96” Snow V Blade Item Number 6958578

4. Authority: Select the appropriate authority below:

☒ FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited:

a. For a brand name restriction: To save money, the USAHEC is looking to replace this vehicle with one that is capable of using already owned proprietary attachments and parts, which are produced by the Bobcat company and only useable on their Tool Cat line of vehicles. At the moment, USAHEC has six attachments for the Tool Cat a Snowblower, Auger, Straight Blade, Broom, Bucket, and Pallet Forks- with a combined replacement value of $37,000.00.

b. If the brand name justification is not approved, The Government would incur additional costs, having to replace the non-mission capable vehicle plus the attachments. This would not only waste funds.

6. Publicizing Contract Actions:

Requirement to post Brand Name justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A)

☒ Action is a brand name restriction, over $25K. It will be redacted and posted with the solicitation.

7. Market Research:

• Queried Government Databases (SAM.gov, GSA, SBA.gov) for mandatory sources that provide relevant information on acquisitions.

• Used Internet tools and preformed web searches (searched for any equivalent vehicles, found none) and also looked for publicly available pricing on the Toolcat

UW56

• Reviewed Federal Service schedule contracts, and other government contracts

When searching on all of the above sites, none produced a vehicle that would have the same capabilities and had the Bob-Tach system other than the UW56.

8. Other Facts: After searching the internet for other brands and vehicles that could fit the same need as the Toolcat, I found that only one vehicle was even equivalent to capabilities that the Toolcat has, that was a Toro outcross 9060. The Toro vehicle has the capability to use similar attachments as the Toolcat however it is not compatible to the Bobtach system. As stated above, USAHEC is in possession of an estimated worth of attachments for the Toolcat. If another product was purchased other than the Toolcat, an additional cost would need to be incurred for this additional equipment.

I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable based upon competition.

I certify that this justification is accurate and complete to the best of my knowledge and belief, and that completing this purchase as a sole source is in the best interest of the Government. Additionally, I approve this justification to limit competition subject to the availability of funds and provided that the services or supplies herein described have otherwise been authorized for acquisition.
