About this file
This memorandum provides a brand name justification for the procurement of Cobham brand parts for the Parachutist High Altitude Oxygen Systems. The Naval Sea Systems Command intends to award a firm fixed price purchase order to authorized resellers of Cobham brand parts using simplified acquisition procedures. The parts being procured include plates, stems, springs, and filters required to rebuild the Parachutist's High Altitude Oxygen System bailout bottle manifold. Cobham Industries is the only approved brand for these life support equipment parts, and use of other replacements would require re-engineering and re-approval. Therefore, procuring on a brand name basis from Cobham authorized resellers is in the best interest of the government to prevent increased costs and delays.
The related solicitation seeks Cobham brand PHOAS bottle parts including specified plates, stems, springs and filters from Cobham Industries. The solicitation will be conducted by the Department of the Navy Naval Sea Systems Command and proposals are to be submitted electronically through the System for Award Management by the specified due date. Evaluation will be based on lowest price among quotations meeting requirements.

Subj: BRAND NAME JUSTIFICATION FOR COBHAM BRAND PARTS FOR THE
PARACHUTIST HIGH ALTITUDE OXYGEN SYTEMS
1. Identification of the agency and the contracting activity, and specific identification of the document as a "Brand Name Justification."
This is a brand name justification. Contracting activity is NSWC-PCD, Code 024, 110 Vernon Ave., Panama City, FL, 32407.
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order to authorized resellers of the Cobham brand pursuant FAR 13.501(a).
3. A description of the supplies or services required to meet the agency's needs
(including the estimated).
The items being procured are "life support equipment" parts required to rebuild the Parachutist's High Altitude Oxygen System (PHAOS) Bailout Bottle Manifold's.
This acquisition will be conducted using simplified acquisition procedures. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c)(l). Application for brand name description FAR 6.302-l(c).
The Cobham brand is the only approved brand for the PHAOS. Any other replacement will not be in compliance and would require a complete change in baseline requiring re-engineering and re-approval. The manufacturer, Cobham Industries, does not authorize direct sales other than through authorized resellers. Therefore, it is in the government's best interest to procure on a brand name only basis as these are life support equipment parts that are certified to prevent more costs and delays in schedule.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.501.(2)(i).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government's needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Airborne Systems North America of NJ, Inc. is the only brand that can meet the Government's needs. This requirement is not exempt from synopsis and will be published to the government point of entry fbo.gov in accordance with FAR 5.102(a)(6).
7. Any other facts supporting the justification.
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Airborne Systems North America of NJ, Inc.is the only brand that can meet this requirement.
Steven Baldomero, Contracting Officer
