Summary of Justification and Approval Document
This is a Justification and Approval (J&A) document for other than full and open competition under FAR 12.102 for a brand-name commercial procurement by the U.S. Department of Navy, Naval Research Laboratory (NRL), Contracting Division Code 1320. Purchase Request No. 57-6025-26 seeks procurement of signal analysis and signal generation equipment from Rohde & Schwarz, Inc. valued at an estimated cost to be funded by FY26 RDT&E funds. The procurement is for one FSWX Signal Analyzer and one SMW200A Vector Signal Generator, with delivery required approximately eight weeks after order receipt. The FSWX Signal Analyzer package includes a 2RF, 44 GHz base unit and various hardware and software options including extension modules, preamplifiers, and spectrum analyzers. The SMW200A Vector Signal Generator package includes the base unit and multiple hardware and software options for frequency range extension, phase noise reduction, baseband generation, and signal processing capabilities across two RF paths.
The NRL Tactical Electronic Warfare Division justifies this single-source procurement on technical grounds, asserting that Rohde & Schwarz equipment is the only solution meeting form, fit, and function requirements for replicating complex electromagnetic emitter emissions simultaneously with strict frequency, timing, and phase specifications. The contractor contends this equipment increases emitter count capability from one to more than six without requiring millions of dollars in additional equipment and saves over $170,000 in license-free software plus approximately $250,000 in labor costs compared to alternative vendors. Market research included contacting the OEM and five authorized resellers; three resellers with GSA schedules confirmed the specific Rohde & Schwarz part numbers are not currently available under their GSA Multiple Award Schedules. The acquisition does not meet small business set-aside requirements under FAR 19.104-1(a), and the Non-Manufacturer Rule cannot be applied as Rohde & Schwarz is a large business without SBA waiver authority under NAICS 334515.

4. Statuary Authority Permitting Other than Full and Open Competition
The authority for permitting other than full and open competition is 41 U.S.C. 1901(e)(2), implemented by FAR 12.102.
41 U.S.C. 1901 41 U.S.C. 1903
5. Rationale Justifying Use of Cited Authority
Code 5713 requires hardware that can replicate the emissions of a multitude of complex electromagnetic emitters simultaneously and with strict frequency modulation, timing, and phase requirements. The proposed hardware extends beyond the capability of current hardware to increase the emitter count (from one to > six) that otherwise would only be achieved with several million dollars more of equipment. The proposed new equipment can accomplish this task as well as signal capture in two pieces of equipment. The hardware from Rohde & Schwarz enables the multitude of signal emissions without the need to purchase extra equipment. Furthermore, there are multichannel capabilities, in conjunction with the electrical capabilities that make the Rohde & Schwarz line items unique to this application. Additionally, these pieces of equipment will help scale with software enabled capability that is currently in place in the TEWD test and evaluation signal processing modeling and simulation code.
The source for the specific instrument listed in Paragraph 3 has been selected to ensure the overall system meets TEWD’s configuration and compatibility requirements. This equipment has been identified as the only solution possessing the necessary form, fit, and function to satisfy Government requirements. Use of any alternative brand or equipment would require additional hardware costs.
Rohde and Schwarz has some license free software capabilities that save in excess of $170,000.
Furthermore, the interoperability with industry standard software like Python and MATLAB is easily translatable, making reuse of previous software likely and saving on labor costs of approximately one half of a man-year, or approximately $250,000 to develop new software programmability should another vendor be chosen instead. Developing new software programmability would also result in unacceptable delays. These costs could not be recovered through full and open competition.
The Contract Specialist has determined through market research that the required products offered by Rohde & Schwarz, Inc. are commercial in nature, valued greater than the SAT, but less than $9.0 million, and as such, this action permits the use of FAR 12.201-1.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research was performed through contacting knowledgeable individuals in Government, conducting internet searches, and contacting the original equipment manufacturer (OEM), Rohde & Schwarz (Rohde). The Contracting Officer, , contacted the Account Manager at Rohde supporting the NRL, via email on 09 July 2026. identified Rohde’s five authorized resellers (ADS, Channel Comp, GovSmart, TestMart/Technical Communities, and Tevet).
In accordance with FAR 8.104, agencies are encouraged to consider satisfying requirements from or through non-mandatory sources, which includes the use of Federal Supply Schedules (e.g. GSA), before considering commercial sources in the open market.
The Contract Specialist contacted the three authorized resellers with GSA schedules to determine if the exact Rohde & Schwarz part numbers are currently awarded under their GSA MAS contract or if they would be able to execute a modification to add them. The three authorized resellers replied and none were able to meet the requirement through their GSA schedules.
This acquisition does not meet the requirement at FAR 19.104-1(a) and therefore will not be set-aside for small businesses. Additionally, the Non-Manufacturer Rule (NMR) requires small businesses to either manufacture the product itself, supply a product manufactured by another small business if it is a nonmanufacturer, or supply the product of any sized manufacturer if the Small Business Administration (SBA) has granted a waiver to the NMR. Rohde & Schwarz, the OEM, is a large business, and the SBA has not granted a waiver under NAICS 334515.
7. Determination of Fair and Reasonable Cost
The Contracting Officer has determined the anticipated cost to the Government for the equipment covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition
For the reasons set forth in Paragraph 5, NRL has no plans at this time to compete future contracts for the type of equipment covered by this document. Code 5713 routinely monitors the commercial marketplace using the internet and publications to stay informed on current state-of-the-art laboratory equipment alternatives that could be used to further work at NRL. If another potential source emerges, NRL will assess whether competition for future requirements is feasible.
In accordance with FAR 12.202(b)(1)(iii) this justification, redacted as necessary, will be made publicly available with the solicitation.
