About this file
This document is a Non-Competitive Procurement Justification Memo from the Naval Surface Warfare Center Carderock Division (NSWCCD) Code 633. The memo justifies the sole-source procurement of one Evac EasyFit DN100 Vacuum Ejector system from Evac North America for a NAVSEA 05P5/F research project investigating foaming properties in shipboard vacuum collection, holding, and transfer (VCHT) systems. The procurement is necessary to accurately simulate foam-causing factors observed in US Navy vessel sewage systems, with the system estimated to have a base cost and a delivery timeline of no more than 32 weeks after purchase.
The justification is based on the unique requirements of the research, which demands using the exact vacuum ejector system employed in US Navy ships to properly evaluate detergent and cleaner foam formation. The memo cites Federal Acquisition Regulation (FAR) provisions allowing for single-source procurement under specific circumstances, particularly for brand-name products or items with unique characteristics. The document includes detailed technical rationale for why only the Evac brand EasyFit DN100 model can meet the research objectives, and it has been digitally signed by the Contracting Officer on October 1, 2025.

NSWCCD SAP Non-Competitive Procurement Justification Memo Effective April 2025
MEMORANDUM FOR FILE
FROM:
CODE: 633
TO: Code 02
DATE: 8/5/2025
SUBJECT: Non-Competitive Procurement Justification Memo for Actions Under SAT
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. FAR 8.405-6 allows for limiting sources for orders or BPAs under Federal Supply Schedules under certain circumstances or for items peculiar to one manufacturer
3. As required by FAR 13.106-3(b)(3)(i), FAR 8.405-6(a)(1), or FAR 8.405-6(b)(2), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE (Include manufacture/sole source name and address.)
Naval Surface Warfare Center Carderock Division (NSWCCD) Code 633, as part of a NAVSEA 05P5/F project to investigate aqueous solutions commonly found in shipboard vacuum collection, holding, and transfer (VCHT) tanks and what may cause overfoamation events, requires procurement of one (1) Evac EasyFit DN100 Vacuum Ejector system. This is a VCHT system used on US Navy vessels to generate vacuum using sewage and store the sewage. The system is estimated to have a base cost of and is to be delivered no more than 32 weeks after purchase.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
A. BRAND NAME. The item required must be a brand name product, or feature of a product, particular to one manufacturer.
1. Restrictive Rights. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements. The item or service is only available from the Original Equipment Manufacturer (OEM).
3. Federal Supply Schedule (FSS) IAW FAR 8.405-6(b).
4. Other Reasons.
As tasked by NAVSEA 05P5/F, Code 633 is investigating sanitary fixture cleaner foaming properties to better define requirements for a detergent/cleaner Commercial Item Description (CID) to prevent excessive foam formation in shipboard VCHT systems. One part of the tasking is to evaluate detergents in the laboratory while simulating the exact foam-causing factors that are observed on a US Navy vessel. As Code 633 and its Philadelphia counterpart have observed first-hand, the excessive foam events most often occur on vessels with sewage-powered ejector VCHT systems. These systems are unique in that the collected and recirculated sewage are pumped through an ejector into the tank. The ejector is an outward conic shaped tube that mixes the sewage with air due to the venturi effect. This venturi action, along with the fluid agitation in the centrifugal pumps that feed the sewage tank, causes foaming in the tanks and is the main focus of this Code 633 laboratory evaluation. In order for Code 633 to recreate these two factors the venturi action and the centrifugal pump fluid agitation in US Navy ship VCHT systems it is imperative that Code 633 conduct the laboratory evaluation using the same vacuum ejector system used on US Navy ships, which is an Evac brand system. Code 633 consulted a representative from Evac North America, who confirmed that US Navy ships use the Evac EasyFit DN100 model components in their sewage-powered vacuum ejector systems. If Code 633 is not able to procure the Evac brand EasyFit DN100 Vacuum Ejector System, Code 633 personnel will not be able to accurately simulate foaming conditions occurring in US Navy ship VCHT systems and therefore will not be able to properly execute and accomplish the NAVSEA 05P5/F tasking.
B. SOLE SOURCE. (select all that apply)
1. Restrictive Rights. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
2. Exclusive Licensing Agreements. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. Other Reasons.
4. Federal Supply Schedules (FSS): IAW FAR 8.405-6(a)(1)
a. An urgent and compelling need exists, and following the procedures would result in unacceptable delays;
b. Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or
c. In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable
