About this file
This document is a Justification for Other than Full and Open Competition (J&A) issued by the U.S. Department of Navy's Naval Research Laboratory (NRL) for the procurement of a Keysight Technologies UXG Agile Signal Generator system. The NRL Tactical Electronic Warfare Division requires this specific brand name system because it is the standard platform currently used across the Navy community, with critical capabilities for generating test waveforms for classified projects. The procurement involves multiple components including a signal generator with features like frequency range 10 MHz to 20GHz, RF output connector, Hz frequency resolution, AM/PM phase modulation, and other specialized technical specifications.
The acquisition will be made on a brand name basis via SAM.gov, as no GSA-authorized resellers are currently available. The total delivery time is approximately 12 weeks after order receipt, with funding from FY25 RDT&E funds. The document explicitly notes that this procurement does not qualify for small business set-aside, as Keysight (the original equipment manufacturer) is a large business. The total estimated cost is redacted, and the Navy has no immediate plans to compete future contracts for this type of equipment, though they will continue monitoring the commercial marketplace for potential alternative sources.

4. Statuary Authority Permitting Other than Full and Open Competition
The authority for permitting other than full and open competition is 41 U.S.C. 1901(e)(2), implemented by FAR 13.501(a).
☒ 41 U.S.C. 1901 ☐ 41 U.S.C. 1903
5. A statement demonstrating the unique qualifications of the proposed contractor, brand name, or the nature of the action requiring use of the authority.
Keysight Technologies, Inc. UXG Agile Signal Generator system was identified as the only brand name system capable of meeting the Government’s minimum requirements for this effort.
The NRL’s Tactical Electronic Warfare Division (TEWD) requires the UXG Agile Signal Generator system because it is the standard platform currently used by other branches within the Division and across the broader Navy community. These units are critical for generating specific test waveforms associated with numerous classified projects. The integrated Keysight ecosystem enables seamless file sharing and waveform reproduction across multiple UXG systems and organizations, ensuring consistency and interoperability. As such, the UXG is not only essential for current efforts but also represents a key asset for future initiatives.
The source for the specific equipment listed in Paragraph 3 has been selected to allow the overall system to meet TEWD’s configuration and compatibility requirements. This equipment was identified as the only equipment possessing the form, fit, and/or function to meet the Government’s requirement. Attempting to utilize any other brand equipment would result in additional labor costs for re-writing existing software, system training for end-users, and the likelihood of ongoing technical difficulties due to synchronization issues. This would result in unacceptable delays estimated at one quarter to one half a man year or $190,000.00.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research was performed through contacting knowledgeable individuals in Government, conducting internet searches, and contacting the original equipment manufacturer (OEM), Keysight.
The Contract Specialist, contacted the Account Manager at Keysight supporting the NRL, via telephone on 10 July 2025. During this discussion, confirmed that Keysight utilizes three (3) authorized resellers, Tevet, Technical Communities (dba
TestMart), and NCSA (dba Tra-Cal), for its equipment. Technical Communities (dba TestMart) was the only vendor authorized to sell the required equipment via GSA; however, their GSA contract expired on 02 February 2025. Additional communication via email with Technical Communities
(dba TestMart)’s VP of Government Services, revealed that TestMart’s GSA schedule has yet to be renewed due to many changes within GSA this calendar year. In accordance with FAR 8.004, agencies are encouraged to consider satisfying requirements from or through non-mandatory sources, which includes the use of Federal Supply Schedules (e.g. GSA), before considering commercial sources in the open market. Since there are no vendors presently authorized to resell Keysight’s equipment via GSA, the Government intends to procure the required equipment on a brand name basis via SAM.gov.
This acquisition does not meet the requirement at FAR 19.502-2(b), and therefore will not be set-aside for small businesses. Additionally, the Non-Manufacturer Rule (NMR) requires small businesses to either manufacture the product itself, supply a product manufactured by another small business if it is a nonmanufacturer, or supply the product of any sized manufacturer if the Small
Business Administration (SBA) has granted a waiver to the NMR. Keysight, the OEM, is a large business, and the SBA has not granted a waiver under NAICS 334515.
7. Determination of Fair and Reasonable Cost
The Contracting Officer will determine that the anticipated cost to the Government for the equipment covered by this J&A is fair and reasonable through adequate price competition (FAR
13.106-3(a)(1)), or through the methods described at FAR 13.106-3(a)(2).
8. Actions to Remove Barriers to Future Competition
For the reasons set forth in Paragraph 5, NRL has no plans at this time to compete future contracts for the type of equipment covered by this document. Code 5762 routinely monitors the commercial marketplace using the internet and publications to stay informed on current state-of-the-art laboratory equipment alternatives that could be used to further work at NRL. If another potential source emerges, NRL will assess whether competition for future requirements is feasible.
