About this file

This document is a Justification for Other than Full and Open Competition (J&A) for the Naval Research Laboratory (NRL). The procurement is for a specific Tektronix 50 GHz digital phosphor oscilloscope system, consisting of two DPO75002SX units, a DPO7USYNC1M cable, extended record length capabilities, a 5-year warranty, an auxiliary front panel, and a multi-unit synchronization cable. The total delivery time is approximately 12 weeks after order receipt, and the acquisition will be funded by the FY25 Capital Investment Program.

The document justifies sole-source procurement from Tektronix due to unique compatibility requirements with existing NRL software and equipment. Specifically, using any other oscilloscope would require re-writing control software, retraining users, and potentially replacing existing Tektronix equipment, with estimated additional costs of $240,000. Market research confirmed that Technical Communities (dba TestMart) is the only authorized GSA distributor for this high-performance, built-to-order equipment. The acquisition will not be set aside for small businesses, as Tektronix is a large business and no Small Business Administration waiver has been granted.

Justification for Other than Full and Open Competition Under Simplified Procedures For Certain

Commercial Items In Accordance With Federal Acquisition Regulation (FAR) 13.5

On the basis of the following, I, as the Contracting Officer, hereby approve the use of a brand name contractual action pursuant to the authority of: 41 U.S.C. 1901 41 U.S.C. 1903

1. Contracting Activity

The U.S. Department of Navy, Naval Research Laboratory (NRL) Contracting Division proposes to include brand name specifications for the procurement of a 50 GHz digital phosphor oscilloscope system, which will be issued utilizing the procedures described in FAR Subparts 12.6 and 13.5 with a brand name only justification.

2. Description of the Action Being Approved

This action requests approval for the use of other than full and open competition, on a brand name basis, as implemented by FAR 13.501(a) for the procurement of a Tektronix, Inc. (Tektronix) 50 GHz digital phosphor oscilloscope system.

3. Description of Supplies/Services

The NRL Tactical Electronic Warfare Division (TEWD), Surface Electronic Warfare Systems Branch, High-Power Microwave Technology Section, is seeking one 50 GHz digital phosphor oscilloscope system, comprised of the following:

50 GHz ATI Performance Oscilloscope System; includes:

o 2 DPO75002SX units and 1 DPO7USYNC1M cable; 2 Ch, 50GHz, 200GS/s or 4 Ch, 33GHz, 100GS/s (Part No. DPS75004SX); Quantity 1 o Extended record length: 1G/Ch (2 Channels) 500M/Ch (4 Channels) (Part No., DPS75004SX 50XL); Quantity 1 o Standard Warranty Extended to 5 Years. Covers parts, labor and 2-day shipping within country; (Part No. DPS75004SX R5); Quantity 1 Auxiliary Front Panel (Part No. DPO7AFP); Quantity 1 DPO70000SX multi-unit synchronization cable; 1-meter length (Part No. DPO7USYNC1M);

Quantity 1

Delivery is required approximately 12 weeks after receipt of the order. The Government’s minimum needs have been verified by the certifying technical and requirement personnel. The estimated dollar value is $ , which will be funded by the FY25 Capital Investment Program.

4. Statuary Authority Permitting Other than Full and Open Competition

The authority for permitting other than full and open competition is 41 U.S.C. 1901(e)(2), implemented by FAR 13.501(a).

41 U.S.C. 1901 41 U.S.C. 1903

5. A statement demonstrating the unique qualifications of the proposed contractor, brand name, or the nature of the action requiring use of the authority.

Tektronix’s 50 GHz digital phosphor oscilloscope system was identified as the only brand name system capable of meeting the Government’s minimum requirements for this effort.

The NRL’s TEWD requires the 50 GHz digital phosphor oscilloscope system to function with existing software that Code 5745 has written for its other Tektronix oscilloscopes. The use of any other oscilloscope system would require Code 5745 to re-write its control software that is used in its current test environment. Additionally, the oscilloscope system must be compatible with existing Tektronix synchronization cables in order for the system to synchronize seamlessly with Code 5745’s other Tektronix oscilloscopes and equipment. Lastly, based on market research performed in accordance with FAR 10.002(b)(2)(i), no other 50 GHz, 200GS/s, oscilloscopes were identified that were also rack mountable.

The source for the specific equipment listed in Paragraph 3 has been selected to allow the overall system to meet TEWD’s configuration and compatibility requirements. This equipment was identified as the only equipment possessing the form, fit, and/or function to meet the Government’s requirement. Attempting to utilize any other brand equipment would result in additional labor costs for re-writing existing software, system training for end-users, and a full replacement of currently owned Tektronix equipment due to synchronization issues. Not only would this result in unacceptable delays, but this duplication of costs is estimated at $240,000.00 and could not be recovered through full and open competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research was performed through contacting knowledgeable individuals in Government, conducting internet searches, and contacting the original equipment manufacturer (OEM), Tektronix.

The Contracting Officer, , contacted Tektronix’s Senior DoD Sales Manager, , via telephone on 12 May 2025. During this discussion, confirmed that Tektronix utilizes three authorized GSA distributors, Fotronic, Technical Communities (dba TestMart), and TestEquity, for its equipment. However, given that the required equipment is classified as built-to-order and is considered high-performance, stated that currently, Technical Communities (dba TestMart) is the only vendor authorized to sell the required Tektronix’s equipment via GSA.

Fotronic and TestEquity would require additional internal approvals. In accordance with FAR 8.004, agencies are encouraged to consider satisfying requirements from or through non-mandatory sources, which includes the use of Federal Supply Schedules (e.g. GSA), before considering
