Justification for Exception to Fair Opportunity Brand Name FAR 16.505(a)(4)(i)
PR 2120G30PWS336
InfoBlox is proprietary and is currently the foundational hardware and software which supports mission critical applications and mitigates major security vulnerabilities. InfoBlox hardware is compatible with the current USCG infrastructure, maintenance platforms, and configuration systems. The USCG requires the use of these products to ensure continued interoperability with other USCG systems throughout the USCG C5ISC. The hardware, software, and warranty described in this action must be provided by an authorized reseller and service provider and be registered with the manufacturer.
The InfoBlox hardware is required to augment an existing investment in the same brand name infrastructure. Deviation from brand name hardware before the end of the useful life of the existing infrastructure investment would represent a significant unplanned expense required to support the enterprise, as well as a substantial duplication of cost and effort to the USCG. The use of other products could result in interoperability, compatibility and interface issues that would preclude the is able to interconnect and function with current USCG network architecture, maintenance platforms and configuration. Procuring an alternate product other than InfoBlox will require a complete infrastructure rebuild and replacement with a significant increase in cost. This involves purchasing and configuring the new equipment, changing control boards, implementation, change control boards for removal of old hardware.
Due to the Infoblox proprietary requirements by the USCG, the contracting strategy which will provide the Government best value is competing the brand-name InfoBlox renewal requirement among the authorized resellers on the DHS First Source II vehicle.
5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer determines that the anticipated cost will be fair and reasonable based on competition as there are multiple authorized InfoBlox resellers on DHS First Source II. The Contracting Officer will seek additional price reductions before placing the order and will also perform a price analysis to determine that the price at the time of award still represents the overall best value for the Government and is consistent with the DHS First Source II vehicle terms.
6. Any Other Facts Supporting the Justification.
None.
7. A Statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisitions for the supplies or services is made.
Currently, InfoBlox products are proprietary and as long as it used on the USCG network the availability of multiple authorized resellers will ensure competition.
