I. Contracting Activity.
375th Contracting Squadron (375 CONS)/PKB1 205 E. Winters St. Bldg 50 Scott AFB, IL 62225
II. Nature and/or description of the action being processed.
375 CONS intends to solicit, compete, and award a new, Brand Name Only (BNO), firm-fixed price (FFP) contract for Remote Power Panels (RPPs) and Power Distribution Units (PDUs) at Scott AFB, IL via the System of Award Management website (SAM.gov) for the 375 Communications Group under the North American industry Classification (NAICS) code 335313. This requirement is for products unique to one manufacturer. Only the Original Equipment Manufacturer (OEM) or their certified resellers can provide the required equipment. A new brand name only (BNO) purchase order will be made utilizing the Brand Name Justification. The resultant award will be a firm-fixed price purchase order for Power Distribution Units (PDUs) that will support the 375 Communications Group's standardized equipment at building 1575 at Scott AFB, IL.
III. Description of supplies/services required to meet agency needs.
Under the following purchase request (PR), 375 CONS intends to acquire brand-name only Eaton RPPs & PDUs to add onto the already present Eaton products equipped on building 1575. The required Eaton products provide power supporting over 500 equipment cabinets in the Scott AFB Building 1575 data center. New RPPs and PDUs will be required as the Government expands the base data center and executes MILCON project. The PDUs ensure that all critical Command and Control (C2) Systems for USTRANSCOM, AMC, SDDC, the 375 AMW and mission partners remain operational day in and day out.
The total estimated dollar value for this acquisition is based on the mission partner's Independent Government Cost Estimate (IGCE). The IGCE and equipment list is based off of market research. The firm-fixed price contract will be funded utilizing Fiscal Year 2022 (FY22) Operations & Maintenance (O&M 3400) funds.
Certified funds for this effort were received on 22 February 2022 in the amount of

IV. Statutory authority permitting other than full and open competition.
AFFARS 5313.501 - 10 U.S.C. 2302b, Implementation of Simplified Acqusition Procedures (41 U.S.C. 1901)
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
FAR 13.104 states that the Contracting Officer must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase.
For the following reasons, the Eaton brand name only items requested for procurement are unique and highly specialized to the acquisition:
The 375 CS/SCX maintains an Eaton Brand Name Electric Distribution System for building 1575 composed of 32 Eaton PDUs, 45 RPP, 3 Eaton Uninterpretable Power Supply (UPS) units and Eaton proprietary software monitoring system.
This facility must have uniformity throughout the critical electrical system in order to support the critical missions requirements for the diverse data center customers. Currently, 375 CS/SCX has 32 Eaton PDU and 45 RPPs that are configured with a Government owned power buss system, 3 Eaton UPS systems and a Government owned power monitoring system. The cost of re-procuring a new system would be approximately , which would not be recouped through competition. If the Government were to re-procure this configuration, there would be an unnecessary substantial duplication of the costs to the Government as the current system would have to be replaced in its entirety to ensure operations of a proprietary system similar in nature.
If the 375 CS/SCX were to get non brand-name PDUs to configure with the system currently established, the negative consequences associated with integrating that new equipment would undoubtedly cost more than if using the Eaton brand. Additionally, if Eaton parts were not procured and there was any type of failure due to using another brand, there would be severe mission stoppage as these PDUs are critical to all C2 Systems for USTRANSCOM, AMC, SDDC, the 375 AMW and other mission partners.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
A sources sought was conducted on both GSA E-buy as well as SAM.gov to seek potential sources for the required

April 2021 CONTROLLED UNCLASSIFIED INFORMATION Page 5 of 6 supplies. GSA yielded three responses. However based on the huge gap in pricing information submitted for market research, it appeared that one of the respondents may not have understood the requirement. The other two responses could have been potential sources.
A sources sought conducted on SAM.gov also received three responses from potential sources, all of which were small businesses.
Additionally, the CO received a phone and an e-mail from a local small business that would also be able to potentially fulfill the requirement. The POC stated that they are registered in SAM.gov.
According to Eaton, they do not have a definitive list of authorized resellers, but they allow Contractors to reach out for products as need be to become a reseller. Based on the market research above, it was determined that soliciting via SAM.gov would yield the most competition and reach as many potential sources as practicable.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer (CO) will determine prices fair and reasonable through use of one or more of the price analysis techniques at FAR 13.106-3(a). Adequate price competition is expected which normally establishes a fair and reasonable price. In the event adequate price competition is not achieved, the CO will utilize other price analysis techniques described at FAR 13.106-3(a)(2).
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
As per FAR Part 8.002(a)(1), a search on https://www.unicor.gov/ and https://www.abilityone.gov/ revealed that neither sources can provide the required EATON PDUs. Therefore, FPI and AbilityOne are not available ordering vehicles for this requirement.
A sources sought was conducted on GSA eBuy and Sam.gov. The GSA sources sought had received one company that could provide the requirement. Therefore, GSA advantage will not be used due to a lack of competition. SAM.gov sources sought had received 2 or more quotes from responsible vendors. This requirement will be solicited using the SAM.gov vehicle to acquire adequate competition.
This requirement will be a 100% small business set-aside with a brand name justification attached.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
All supporting justification is documented above.
X. List of any sources that expressed, in writing, an interest in the acquisition.
See Section VI above.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition
Sole Source (Including Brand Name) Justification - Simplified Procedures for Certain Commercial Items
April 2021 CONTROLLED UNCLASSIFIED INFORMATION Page 6 of 6 before making subsequent acquisitions for the supplies or services required.
Barriers to competition consist of the Government's limited ability to secure equipment and system support by any source other than Eaton Corporation and their authorized resellers. However, prior to any subsequent acquisitions, market research will be conducted to determine if there are any other alternatives or viable solutions for future acquisitions.
