4. Identification of Justification Rationale

The circumstances and rationale for limiting consideration to select contractors for award follows:

In accordance with FAR Part 11.105, “Agency requirements shall not be written to require a particular brand, name, product...peculiar to one manufacturer, thereby precluding consideration of a product manufactured by another company.” An exception to this rule is allowed only if there is a written justification...essential to the Government’s requirement.

Additionally, this limited source justification will document that this requirement is essential to the Government’s requirements and the market research which indicated that no other brand is qualified to meet the Government’s requirements.

5. Demonstration of the Unique Nature of the Required Supply

On April 30, 2024, the requiring agency submitted a Brand Name Justification Memorandum in accordance with FAR 6.302-1(b)(2), to limit sources for the purchase of the above referenced Ansys Part Numbers.

The compatibility requirements are met by this software, Ansys and its derivative products, as they are the primary computational domain modeling and simulation tools utilized at NUWC Keyport and support multi-disciplinary integration of current and future simulations.

Additionally, training in Ansys software is provided to the modeling and simulation sectors of the workforce. Furthermore, Ansys is recognized as the main modeling and simulation tool employed by academic partners at WSU Bremerton, who are supported by NUWC Keyport through the Senior Design program. The use of Ansys products at NUWC Keyport ensures ongoing collaborative compatibility with WSU Bremerton.

Therefore, for this acquisition, the contracting activity is soliciting on an unrestricted basis from sources that can provide the Ansys part numbers listed above.

6. Determination that the Order Represents the Best Value

The overall goal of the Acquisition Center is to provide the Government a fast and efficient way for Federal Agencies to requisition for commodities at discounted prices with prompt, cost effective delivery and customer service. The Contracting Officer will compare the pricing to competitive pricing to determine the best value to the government and determine that the anticipated costs represent the best value to the government. Award of any products other than the above-mentioned brand name products would not be in the best interest of the government.

Notice of this Brand Name only action will be posted on SAM.gov.

7. Description of the Market Research Conducted

In accordance with FAR 6.303-2(b)(8), the customer has provided detailed market research that has been conducted to justify this RFQ as brand name only. The aforementioned product, Ansys licenses, is compatible with the current systems and ensures Keyport is in compliance with IA directives causing no impact to operations and customers. Additional market research was conducted in June 2024. This research consisted of reviews of similar previous procurements and a market survey through search engines of open market contractors and Federal Supply Schedule contractors. Search engines utilized include Google and the GSA Advantage catalog using the part numbers. A review of GSA Advantage revealed that three of the products are not available via multiple MAS schedules.

8. Statement of Actions to Overcome Barriers to Competition

Prior to any subsequent procurement the market will be reviewed to assess whether any other qualified sources are available and are able to meet the Government’s requirements.

9. Contracting Officer Certification and Approval

I certify that the justification for Other Than Full and Open Competition is accurate and complete to the best of my knowledge and belief. Based on the above, I hereby determine that it is in the best interest of the Government and most appropriate for this acquisition to be Brand Name.
