About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) for a federal contract procurement.

The U.S. Department of Energy (DOE), Office of Headquarters Procurement Services (MA-66), is establishing a single-award Blanket Purchase Agreement (BPA) with Bloomberg New Energy Finance (BNEF) for online subscription services to BNEF/Terminal licenses under sole-source authority. The ordering period runs from November 1, 2026 through October 31, 2027. The BPA will be structured as a Firm Fixed Price (FFP) agreement with a total government ceiling estimate that is redacted in the document. The subscription services include access to Research Notes, Analyst Reactions, Quarterly Outlooks, Conference Calls, Sector Specific Models, and Proprietary Data covering Global Renewable Energy Project Data, Policy Tracking, Market Forecasts, and Sector-Specific Analytics. DOE determined that BNEF is the sole provider of this specific combination of services required to support the agency's mission in monitoring financial energy marketplace trends, conducting risk evaluations, and informing policy decisions regarding the energy transition over the next decade.

Market research was conducted through a Notice of Intent (NOI) released on August 20, 2026 and closed September 4, 2026, providing potential offerors fifteen days to submit capability statements. No responses were received indicating alternative providers can deliver equivalent services. The justification emphasizes that BNEF's proprietary nature and specialized expertise make continuity with Bloomberg critical for consistency and alignment with DOE's established market research and risk evaluation framework. The acquisition is authorized under 41 U.S.C. § 3304(a)(1) and FAR 6.103-1 (only one responsible source) in conjunction with FAR 12.102(b) for commercial products and services.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

IN ACCORDANCE WITH FEDERAL ACQUISITION REGULATION (FAR) 6.104

(DEVIATION)

U.S. DEPARTMENT OF ENERGY

BLOOMBERG NEW ENERGY FINANCE & TERMINAL

IDENTIFICATION NUMBER SOLICITATION NUMBER: 89303026NMA000103

1. Identification of the agency and contracting activity, and specific identification of the document as a Justification For Other Than Full & Open Competition (JOFOC).

The Department of Energy (DOE), Office of Headquarters Procurement Services (MA-66), located in Washington, DC proposes to establish a single award Blanket Purchase Agreement (BPA) for Bloomberg NEF (BNEF)/Terminal licenses by means of other than full and open competition. This action is in support of the Office of Management‘s (MA) Departmental Elements including, (List the DEs). This document sets forth the justification and approval for the use of the exception from full and open competition. This action is being taken under the authority of 41 U.S.C. § 3304(a)(1), as implemented by FAR 6.103-1 (Deviation), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements,” in conjunction with FAR 12.102(b) (Deviation), applicable to the acquisition of commercial products and commercial services.

2. The nature and/or description of the action being approved.

In accordance with the procedures under FAR Overhaul 12.102(b), using the statutory authority of 41 U.S.C. 1901, and consistent with the content requirements of FAR 6.104-1, this is a new sole-source single-award Blanket Purchase Agreement (BPA) acquisition for Bloomberg New Energy Finance (BNEF)/Terminal online subscription services. The subscription service includes access and use of items such as Research Notes, Analyst Reactions, Quarterly Outlooks, Conference Calls, Sector Specific Models and Proprietary Data. BNEF is the only known provider of the specific combination of Global Renewable Energy Project Data, Policy Tracking, Market Forecasts, and Sector-Specific Analytics required by DOE. The ordering period of performance is November 1, 2026 through October 31, 2027.

In accordance with FAR 12.201-1(e)(3) (Deviation), the BPA will facilitate the acquisition of recurring commercial subscription requirements through individual orders issued as needs arise during the established ordering period. Orders will be placed in accordance with the applicable terms and conditions of the BPA and the ordering procedures prescribed un

3. A description of the supplies and/or services required, to meet the agency needs (the estimated dollar value of the acquisition).

The Department of Energy has a need for this subscription as it provides the agency with updated base-case scenarios (A base-case scenario is a financial or operational projection that represents the most realistic and probable outcome for a business, investment, or project under normal operating conditions), a deep dive into key trends affecting the energy transition in the next 10 years and provides valuable information for policymakers navigating the energy markets. BNEF includes access and use of its proprietary services such as Research Notes, Analyst Reactions, Quarterly Outlooks, Conference Calls, Sector Specific

8. A description of the market research conducted and the results or the reason market research was not conducted.

Market research was conducted by means of the Notice of Intent (NOI) to sole source.

Potential offerors had fifteen (15) days to submit to the Contracting Officer their capabilities.

We received no capability statements that illustrate that they can provide BNEF or terminal online subscription services as requested in the NOI. BNEF is the sole provider of Bloomberg Terminal and BNEF services. There are no resellers for these services. BNEF financial services and data platform uniquely supports DOE’s mission by offering insights not available through other vendors.

9. Any other facts supporting the use of sole-source (provide an estimate of the cost to duplicate these services).

Given the proprietary nature of the services requested and the specialized expertise required for its refinement and implementation, continuity with Bloomberg (BNEF) is critical to ensure consistency, accuracy, and alignment with DOE’s market research and risk evaluation framework.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

None.

11. A statement of any actions the agency will take to remove or overcome any future barriers to competition.

There are no barriers to competition for the future acquisition of this requirement.

DOE will review any subsequent requests for acquisitions of similar services and will ensure that any restrictions to competition are adequately supported and documented.
