3. Rationale Justifying Use of Cited Regulatory Authority.

a.) The Items Described in Paragraph 1 Must Be Compatible In All Aspects

(Form, Fit And Function) With Existing Systems Presently Installed.

b.) A Patent, Copyright, or Proprietary Data Limits Competition.

c.) The Items Described in Paragraph 1 are “Direct Replacements”

4. Implication of Procuring another Brand/Manufacturer.

a.) Unacceptable Delays in Fulfilling the Agency’s Requirements.

b.) Substantial Duplication Of Cost To The Government That Is Not Expected

To Be Recovered Through Competition.

The exact Spectral Systems part number is required for compatibility with an FTIR spectral analysis method developed by the Navy Metrology R&D Program to verify the cleanliness of Navy oxygen system components.

Navy-required features described in paragraph 1 are detailed in US Patent No.

10,634,466 B2, Apr. 28, 2020. The patent describes modifications to a Spectral Systems COTS liquid transmission cell that are required to perform the FTIR measurement needed for the spectral analysis method referenced in paragraph 3a.

The Navy worked with Spectral Systems to develop and test a liquid transmission cell that incorporated the Navy’s required features referenced in paragraph 3b. No other manufacturer was found that was willing to build liquid transmission cells incorporating these features.

Navy calibration laboratories are currently operating under a waiver to OPNAV M-

5090.1 from CNO that enables Navy labs to continue using CFC-113 solvent to clean oxygen system components. This waiver was granted to provide the Navy Metrology R&D Program sufficient time to complete the development of the cleanliness verification method referenced in paragraph 1. Seeking another manufacturer will cause further delays to development and fielding and will not enable the Navy Metrology R&D Program and Navy calibration labs to comply with the conditions of the CNO’s waiver.
