4: Authority Cited:
FAR 6.302-2: Unusual and Compelling; Citation: 10 W.S.C. 2304(c)(2 5: Identification of Justification Rationale:
The government did pursue this action consistent with 6.302-2(c)(2); agencies shall request offers from as many potential sources as is practicable under the circumstances. Contact was made with several sources from the immediate geographic area. These contacts were made by telephone and electronic mail. The immediate geographic area is appropriate due to rapid response required, equipment and staff availability, and potential licensing issues. Three vendors did make site visits and provided proposal input within 48 hours.
6: Determination of Best Value:
Three competing proposals were received. The proposals were evaluated on least cost technically acceptable consideration. The final cost is within the funding parameters approved.
7: Market Research Conducted:
Market research involved local source avenues; company listings, internet search and recommendations from area fire suppressant equipment and servicing agencies. Initial telephone conversations concerning the materials involved, the building content, and materials involved in the production operation did narrow the field of competitors some. There was intent to utilize the services of a small business. This was investigated through CCR searches by NAICS and verbally with the companies contacted.
8: Other Factors / Contributors:
NA
9: Actions to Remove Barriers to Competition Prior to Subsequent Acquisition:
Competition was sought and accessed under the circumstance and urgency of the production condition. Had the situation not required comparatively immediate action the acquisition would have been synopsized according to FAR 5.101(a)(1).
10: Fair & Reasonable Cost Determination:
Items 6 and 7 address this consideration.
11: Reference to Supporting Technical Representations:
The government’s technical representatives from life and fire safety, environmental department staffing, the facilities maintenance group and operational personnel were consulted in the pursuit of clean up, remediation and recharging parameters for the facility.
I hereby certify that this justification and approval is accurate and complete to the best of my knowledge and belief.
