The rationale supporting the use of 10 U.S.C. 2304(c)(1) is that the services needed are available only from one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the Agency as described below. In accordance with FAR 6.302-1(a)(2)(iii), services may be deemed to be available from only the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition or unacceptable delays in fulfilling the Agency’s requirements.
When considering the specialized requirements described in Section 3 above that are required to be performed across multiple JSC organizations, including the mission programs during a “ramp up” in flight tempo, the BITSec contractor, Cambridge International Systems Inc., is the only contractor that is able to provide services without introducing unacceptable delays as well as substantial duplication of costs that would otherwise be incurred if NASA were to competitively procure one or more new contracts for these services during the minimal time interval
6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
A notice to the Government Point of Entry (GPE) website (beta.sam.gov) was published on January 22, 2021, in accordance with FAR Subpart 5.2. This posting informed potential sources of NASA’s intent to award this sole-source modification to Cambridge International Systems Inc. The results of this synopsis are summarized in Section 10 below.
7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. The Contractor shall be required to submit a proposal to be evaluated and negotiated by the Government. Prior to execution of the contractual instrument, a proposal analysis will be performed. The proposal analysis will ensure that the final agreed-to price for the contract action is fair and reasonable. The proposed costs will be evaluated for fairness and reasonableness by comparing the proposed cost estimates to historical information for similar work under the contract, disclosure of a certificate of current cost or pricing data and based on other information that is available regarding current market prices. The Contracting Officer will ensure inputs from the Contracting Officer’s Representative and/or technical representatives are incorporated, as well as other information that may be available to the Government at the time of receipt of the contractor’s proposal.
8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:
The following market research was conducted in preparation for this acquisition:
Rev.:10/2020
• The Government reviewed other Agency contracts for similar services to determine if some or all of the requirements could be met by current contracts
The following Agency contracts were reviewed:
o Glenn Research Center, Professional, Administrative, Computational, and Engineering (PACE IV), NNC14BA04B (POP ends 2/28/21) o Langley IT Enhanced Services II (LITES II), NNL15AA03B (POP ends 4/30/21) o Kennedy Space Center, IT Support Services II (ITSSII), NNK17OK01Z (POP ends 9/30/21)
It was determined that the period of performance of the contracts listed above expire before the end of the BITSec period.
o NASA Integrated Communications Services (NICS) Contract, NNM11AA04C (POP 5/31/21): It was determined this contract does not contain the same IT security scope as the BITSec requirement.
o NASA Headquarters, Headquarters Information Technology Support Services (HITSS III), 80HQTR18C0029 (Options through 3/31/24). The HITSS III contract includes this requirement; however, transition to HITSS introduces an unacceptable level of risk. See Section 9.
o Ames Research Center, Ames Consolidated Information Technology Services (ACITS) 4, 80ARC020D0006 (POP ends 10/31/25). The ACITS contract includes this requirement; however, transition to ACITS introduces an unacceptable level of risk. See Section 9.
• The BITSec task order was issued through a GWAC, which satisfies the requirement for sources through Government-wide databases such as the Interagency Contract Directory.
Based on the market research stated above, increasing the maximum ordering limit for the BITSec task order issued under the NIH CIO-SP3 GWAC reduces the risk posture for JSC IT security support, particularly to Agency programs, and is the most cost effective approach to satisfy the IT security delivery requirements
9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:
NASA recognizes that other offerors, the HITSS contractor and ACITS contractor may be able to provide the necessary IT security management and technical services, but not under the constraint that the effort must start on November 1, 2021. JSC’s primary mission is Human Space Flight and the JSC IT Security Office contributes to mission assurance and flight readiness across local, national, and international critical mission IT. Given the current increase in flight tempo at JSC, transitioning to a new contractor for a minimal timeframe is neither practical nor safe and poses a high risk to the JSC IT Security Program’s ability to support both JSC and Agency Mission Programs. JSC’s IT Security Program is an integral
