DESIGN- BUILD PROGRAM

Section 4: Design- Build Requirements

1) The Contractor will be responsible for all aspects of design and construction to complete the project objectives. All required Architect and Engineering (A/E) services are to be provided in house by a licensed A/E or subcontracted out by the Contractor to a licensed A/E.

2) The Contractor shall provide design services, including field surveys of as-built conditions, coordination with GSA and the tenant agency, and preparation of the bidding documents and construction administration necessary to perform the work as described herein.

3) Based on design approval, the contract will then move into construction/implementation of the design as outlined in the design documents and the below construction segment of this document. Upon receiving written approval from GSA the contractor may begin construction prior to design completion.

DESIGN PHASE

Section 5: Project Background & Project Description The GSA is initiating a project to integrate the existing snowmelt system into a new concrete sidewalk on the north side of the building. In the past, ice has formed on the sidewalk from snowmelt off the building during the colder months of the year. GSA would like to add the sidewalk snowmelt hydronic system to the existing ramp hydronic system.

Section 6: Project Objectives Design services required to accomplish the project: The Architect-Engineer (A-E) shall provide design services, including field surveys, coordination with GSA and the using

Agencies and preparation of the bidding documents necessary to perform the work as described herein. The contractor shall address the following construction concerns in their design. Design shall be in compliance with the GSA P100 and local code requirements.

1) The contractor is responsible for obtaining public and private utility locates prior to performing any excavation activities.

2) Concrete Demolition:

a. No work shall begin until all the vehicles are moved from the parking spots around the sidewalk.

b. Lock-out and Tag-out the two exterior doors until all work on the new sidewalk is complete.

c. The contractor shall remove approximately 711 SF of concrete. The thickness of the concrete sidewalk is approximately 6 inches thick. The concrete also includes rebar that needs to be removed with the concrete.

3) The existing curb shall remain in place and the expansion fiber board shall be removed and replaced.

4) Snow Melt System:

a. The snow melt system shall operate and function off portions of the existing ramp snowmelt system.

b. The Engineer will need to test the existing system to see if the system is capable of handling the additional snowmelt for the sidewalk.

c. The sidewalk should run independently with a moisture sensor because there are times when snow melts off the building and builds up on the sidewalk below, separate from when the ramp is in operation. The system should also have the capability of operating manually.

d. The new system tubing shall be imbedded in the new concrete sidewalk and shall be zoned according to manufacturers specifications.

5) New Concrete Sidewalk:

a. The concrete shall be 4000 psi at a minimum with 6% - 8% air entrainment and have no more than a 4” slump.

b. All reinforcement shall be #4 grade 60, deformed rebar shall be used and installed according to industry standard but no more than a 16” grid and tied at every other lap. All drivable surfaces shall have a minimum #4 rebar 12” OC in 6” thick concrete. The sidewalk shall be pinned to the building every 2’.

c. All concrete shall be finished with a medium broom finish perpendicular to traffic to prevent slipping.

d. The contractor shall replace the concrete ramp and handrails at the center door of the building. Ramp shall meet Architectural Barriers Act (ABA) standards.

e. Spray curing compound immediately after finishing. Curing compounds shall have “fugitive” pigments that dissolve over time to provide non-tinted/non-stained concrete.

f. If weather conditions cause rapid drying of eh pavement surface, use a fogger to apply a fine mist to the concrete surface for interim curing. Fog immediately behind the tinning float and maintain fogging to produce a sheen on the surface until the curing is applied, do not apply with brushes.

g. If ambient temperature falls below 40ºF, maintain the concrete surface temperature between 40ºF and 90ºF for the duration of the curing process.

If High-early strength concrete is used maintain the surface temperature between 50ºF and 90ºF. Conduct heating operations to avoid sudden temperature changes in the concrete, before removing any enclosures, decrease the concrete’s surface temperature to the air temperature at a rate not to exceed 15ºF per hour.

h. Contractor shall make sure suitable material is used as a base material.

NDDOT class 5 or better granular material shall be used for base and be a minimum of 6” in depth.

i. Contractor may use admixtures to minimize curing time, for additional admixtures and retarders may be advisable for hot or cold weather conditions. Any and all admixtures must be submitted for approval before use.

j. Chairs shall be used to support rebar for concrete placement.

Section 7: Proposal Pricing & Site Walk

1) Pre-proposal Site Visit Meeting:

a. The site visit shall consist of a meeting to review the design requirements followed by a walk-thru of the project site. The meeting shall be attended by the A/E and GSA project personnel, and appropriate sub-contractors.

b. The A/E shall perform any site reviews necessary to ensure the design documents correctly reflect the existing conditions of the project area to include any field verification.

c. Review the solicitation/evaluation requirements.

2) Cost Proposal Requirements:

a. Design Pricing- When submitting a proposal, provide a cost breakdown for each task based on estimated unit hours to perform each task.

b. Construction Pricing- When submitting a proposal, provide a cost breakdown for each task into the following categories: Materials, equipment, labor hours, subcontractor's quotes, overhead, profit, and bond broken down into shell, tenant improvement (TI) (by tenant), Building- Specific Amortized Capital (BSAC), and environmental (as applicable). Follow P120 guidelines for tier level 3 based on project triage tool. Pricing shall be broken down by Construction Specification Institute (CSI) divisions.

c. Base Bid- Design & Construction

** Workers in this classification may be entitled to a higher minimum wage under Executive Order 14026 ($15.00) or 13658 ($11.25). Please see the Note at the top of the wage determination for more information.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour National Office because National Office has responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.

END OF GENERAL DECISION"

II. Prices

II.A. Basis of Pricing

(1) Contract Prices. All Contract prices set forth in this Section include all costs necessary to complete the work for which the price is established (e.g., Base Contract, Unit Price, Options) in accordance with the Contract Documents, including, but not limited to, the cost of work performed by subcontractors and consultants, indirect costs, fees, expenses, taxes, and profit.

(2) Knowledge of Conditions Affecting Price. FAR 52.236-3, Site Investigations and Conditions Affecting the Work, is incorporated by reference in this Contract. The Contractor shall be presumed to have established all prices with knowledge of general and local conditions that may affect the cost of Contract performance at the site where the Work is to be performed, to the extent that such information is reasonably obtainable.

(3) Unit Prices and Allowances. If any portion of the Work is to be performed on a unit price basis, the Unit Price shall include all costs of coordinating and incorporating the unit-priced portion of the Work into the Base Contract Work. The Contractor shall only be obligated to perform unit-priced work to the extent that an Allowance has been established. The Contractor shall be obligated to perform such work in excess of a unit quantity for which an Allowance is established only if directed by the Contracting Officer in writing. The Contractor shall be bound to the unit price or prices set forth herein in all equitable adjustments for changes including unit priced work, and no markups shall be applied to such unit prices.

(4) Options. If any portion of the Work is to be performed upon the timely exercise of an Option, the Option Price shall include all costs of coordinating and incorporating the Option-priced portion of the Work into the Base Contract Work. An adjustment to the Contract price for such additional work shall be computed solely on the basis of the Option price or prices set forth herein. Unless otherwise specified, all options may be exercised within 90 days of Contract award.

(5) Bid Rates. If this Contract includes Bid Rates to be used in determination of equitable adjustments (e.g., overhead, profit, daily rates for time-related costs), such rates shall be deemed to include all costs recoverable as components of an equitable adjustment consistent with the requirements, definitions, and exclusions applicable to equitable adjustments set forth in this Contract, and consistent with the Contractor's cost accounting practices. Unless otherwise specified, the bid rates shall be deemed to include only the Contractor's costs, and not the costs of any subcontractors.

It is the Contractor's duty to include in proposals for equitable adjustment or other consideration all compensation to which it may be entitled, including cost and time.

Unless otherwise explicitly stated in a modification to the Contract providing such consideration, adjustments to the Contract price or time agreed upon therein shall be deemed to provide all compensation to which the Contractor is entitled, and shall constitute final settlement of the Contractor's entitlement to compensation on account of the change or other condition giving rise to the modification.

III.E. Liquidated Damages

The Contractor acknowledges that time is of the essence for the performance of the Work, and that determining actual damages from delay would be extremely difficult and impractical. The Contractor shall submit to the Contracting Officer all renewal certificates issued during the life of this Contract immediately upon issuance.

III.G. Order of Precedence
