About this file

This document is a Sole Source Determination and Justification for the purchase of 15,000 Biomark APT 12 pre-loaded PIT tags by the Oregon Department of Fish and Wildlife (ODFW). The PIT tags will be used to gather vital data on the Deschutes River Stock hatchery spring Chinook program, which is critical given the extremely low adult returns in recent years. The Biomark APT-12 PIT tags are the sole and commonly used tags for this purpose, as they are compatible with the existing pit tag detection equipment at Round Butte Hatchery and the in-stream pit tag detection equipment on the Columbia River dams. There are no other known options available that would allow ODFW to accurately gather the necessary data using their existing equipment.

The estimated cost of the purchase is not provided, but the justification cites the unique design, availability, and compatibility requirements as the rationale for the sole source determination. The purchase is a single purchase for 2025, and the ODFW has provided a letter from the product manufacturer, Biomark Inc., stating that they are the sole manufacturer and seller of the product, with no resellers.

SOLE-SOURCE DETERMINATION & JUSTIFICATION

FOR SUPPLIES AND SERVICES

OregonBuys S-63500-00011847

To: Contract Services

From: Ryan Moon Date: 9/19/2024

Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275 for:

Description of Goods or Services:

15,000 Biomark APT 12 pre-loaded pit tags. Biomark item# BIO 12.B04V2PLT.

Reason for Need:

Pit tags will be used to gather vital data on The Deschutes River Stock hatchery spring Chinook program.

This data is especially vital considering the extremely low adult returns encountered the last few years with Deschutes Stock spring Chinook. Data is used by ODFW to determine in stream adult return run estimates by year which guides us in making sound management decisions.

This study is being conducted on hatchery spring Chinook smolts raised and released at Round Butte Hatchery. The study will evaluate the effectiveness at increasing the number of adult returns of hatchery spring Chinook to the Deschutes River.

The Biomark APT-12 pit tags are the sole and commonly used pit tags for this purpose. They provide accurate and timely data to meet our needs. They are also the only pit tags that work in conjunction with our pit tag detection equipment at the hatchery (also manufactured by Biomark) as well as the in stream pit tag detection equipment located on all the main stem Columbia River Dams. There are no other known options available which would allow us to accurately gather this vital data using our existing equipment.

Single of Multiple Purchases:

Single purchase for 2025.

Estimated Cost:

Research Leading to Determination:

Research conducted using internet search could not provide an exact match for the specifications required (size, ISO standards, immersion capability, frequency, speed and distance detection for fish etc.). See attachment for specifications of Biomark APT-12 tags designed specifically to meet the needs for accurately detecting instream fish movements.

Presently all equipment installed for detection of pit tags at Round Butte Hatchery was designed and manufactured by Biomark Inc. The equipment was specifically designed to quickly and accurately detect, download and store the radio frequency identification emitted by the Biomark APT-12 full duplex tags which have been implanted in the Round Butte Hatchery spring chinook. The equipment is not compatible with other RFID tags manufactured with different specifications.

Analysis of Research / Findings of Fact:

Pursuant to OAR 125-247-0275(2)(a): Compatibility.

This purchase will add to an existing PIT tag monitoring study that utilizes Biomark PIT tags and Biomark readers and receivers. To be compatible with existing equipment, radio tags must be able to be detected by the existing radio telemetry receiver network and interrogation frequency of

134.2 kHz +/-1.

Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data.

Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.

Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project.

Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.

Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of:

unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.

See letter attached from product manufacturer stating they are the manufacturer/seller of the product and have no resellers, or that they are the authorized reseller for the area in which the purchase will be made.
